2026-08-19 - Conservation Commission Meeting

Summary

The meeting opened with a public inquiry from a Glen Shore Road resident alleging storm water runoff from a neighboring driveway damaging his foundation; the conservation agent had not yet inspected the site and planned to visit during a future storm. The board then worked through a long list of routine hearings and continuances (360 Worcester Road, 29 Snake Hill Road, 80 Richardson Corner Road, 18 Oxbow Road, Lot 5 Smith Road all continued to September 9; 11 Sunset Drive tabled after a post-permit fire; Lot 3/4 Smith Road, 125-0 Southbridge Road, and 70 Beach Road closed with orders of conditions; 40 Carol Hill Road and 5 Roberts Boulevard issued negative determinations), several routine certificates of compliance (59 Frame Metro Road, 6 Lambs Pond Circle Lot 2, 21 Brackett Hill Road Lot 26), and ratified an enforcement order tied to a cell tower project at 103 Bond Road where a wetland violation is being remediated. An order of conditions for a Water Road project (DP 128-2013) was reissued after the original property owner's vehicle fire destroyed the recorded copy.

The conservation agent then gave a detailed enforcement update on the 24 Sturbridge Road Storm Water Violation, reviewing the violation history, fines, and litigation posture; construction was reported stopped as of the meeting. The board also voted (6:30 start time for hearings, previously discussed) to move public hearing start time to 6:30 PM going forward. The meeting closed with an extended discussion of the Wake Surfing Bylaw - South Charlton Reservoir, with testimony from Jim Triplet, Dennis (South Charlton Reservoir Wake Surfer), and Stephanie (Former Lake Association Officer); the commission voted to authorize the conservation agent to solicit study proposals funded through the municipal waterways fund.

0:04 | Call to order. Any public inquiries?
0:10 | We do actually. We had resident from Glen Shore Road uh having a complaint
0:17 | about having a complaint making a complaint about storm water runoff um coming from
0:25 | a neighboring uh porn on a butter uh the driveway. So, he provided some pictures.
0:30 | I haven't been there yet. I think it would be beneficial to go there when it's raining, but the picture is pretty uh straightforward as you can see how the driveway is pitched to his property.
0:44 | Oh, yeah. Yeah.
0:46 | So, if you don't mind passing around, just trying to figure out where that was, but that's Dat's house. Okay. Interesting.
0:53 | So, I wait for a good storm and I drive there to take a look at it. As we know,
0:59 | our bylaws doesn't allow any uh water being discharged into an abing property.
1:06 | That's your house. No, not your road.
1:09 | No, it's not my road either. It's on my lake, but Well, that's a flat side, right?
1:17 | It's down It's on my side, but it's down in the small end.
1:26 | So I don't know. Apparently has been there for so many years. I Yeah. I don't know that.
1:32 | Yep. Has been affecting his foundation.
1:38 | He has been trying to remediate it on his property. I don't just don't know why it took so long to bring it in front of us.
1:50 | [clears throat]
1:55 | You sit down. You got stuck at Ron. Got to take a look at him.
2:00 | Oh, you I thought you hit him already. No.
2:08 | See the driveway. So, I'll wait.
2:19 | All right. Approval of minutes July 15th, 26. Yeah, I need a motion. I need a motion.
2:27 | Motion made. Second. Second. All in favor? I. All opposed. The eyes have it. 360 Worester Road.
2:37 | Uh, we'll be continue this to September 9.
2:43 | You need a motion to continue the hearing. Motion to continue. I need a second. Second. All in favor? All opposed? The eyes have it.
2:52 | That was what? September what? Nine. Nine. 11 Sunset Drive.
2:58 | We did have a GP number issued and uh we had no issues with the project. However, uh the property caught on fire few weeks ago.
3:09 | So, they will have to u include the restoration or the demolition. I don't know what they were going to be proposing. So my recommendation to the
3:16 | commission is with instead of withdraw the application so the applicant doesn't have to refile, could we table for a couple meetings until he makes a
3:25 | decision of how he's going to come back to us? I need a motion on that. Tableing it. I'll make that motion. Need a second? Second.
3:32 | All in favor? All opposed. The eyes have it.
3:39 | lot three and four Smith Road.
3:53 | I can't read. What's up?
4:03 | Go ahead.
4:03 | All right. Um Jason Dubo, DC Engineering and Survey. Uh this property is owned by um James Gillies. It's about 20 20
4:11 | acres. Uh he did combine recently two lots on Smith Road, lots three and four.
4:17 | Uh so this is now combined. He's proposing a single family home and also a detached garage with a septic system, a well, about a I think it's about a 600
4:27 | foot long driveway down through the woods to get to the back area.
4:30 | [clears throat] Um there's a narrow strip up by the road just to get your bearings. The road is up here. This is a long driveway that
4:37 | comes down. Um there's all wetlands that kind of flow through this area here, all down in here, and they continue in the
4:46 | back here. Uh so we're proposing a like I said a single family house with a septic system and a well. Uh we do have some drainage, some uh storm water management on the sides of the driveway.
4:56 | We have swailes to catch the water uh treat it, slow it down. We have check dams every 100 feet or so. Um this [clears throat] has been through
5:05 | peer review as well uh through Haley Ward. So they're they're all set as far as I know. Uh we do have a DP number.
5:12 | Um, so if there's any specific questions on the plan, I can answer them for you.
5:19 | Anybody on the board have any questions?
5:28 | [clears throat]
5:30 | Anybody?
5:32 | Anybody in the audience have any questions?
5:43 | So where is that?
5:47 | Um we're not proposing any alteration any wetlands. It's just buffer zone work.
5:57 | Was that it? Was that your question? Yes. Okay.
6:01 | You also Yes.
6:07 | Jason, what is that sound? That's them.
6:19 | You want to see that?
6:21 | I can I Any questions?
6:30 | You all set? I need a motion to close the hearing. Issue order conditions. Motion made. Need a second.
6:38 | Second. All in favor? I. All oppose. The eyes have it.
6:51 | Worster road. That's continued to September 9th. I need a motion. Continue to hear it.
6:57 | Need a motion. Okay.
7:05 | 29 Snake Hill Road to September 9th.
7:15 | I need a motion continue the hearing. Motion to continue. Second. All in favor? I.
7:21 | All opposed. The eyes have it. 80 Richardson Corner Road.
7:28 | So I don't know if the commissioner remembers uh Pvoski was here last meeting explaining uh
7:36 | giving a response from uh to DP comments uh related to the ponded area at the
7:45 | property. Um unfortunately this took a bit for him to come up with the studies because we were in a drought. So what DP
7:54 | wanted is to prove that there was no unidirectional flow meaning the the area
8:02 | was pounded and there was no stream running so it wouldn't uh so the activity would not be subjected
8:09 | to riverfront area and uh I did he submitted enough evidence which he provided to the commission last time I
8:17 | went to a side inspection with him and I did agree that it does not show any directional flow. So now he's coming
8:26 | with the delineation in front of the commission shortly so we can actually approve the the So we're going to continue to hear.
8:33 | So we'll have to continue to September 9th.
8:35 | Okay. Anybody in the audience have any qu in the board have any questions right now? Anybody in the audience have any questions right now?
8:44 | I need a motion to continue the hearing. Motion to continue. Second.
8:49 | All in favor? I I All opposed. The eyes have it. Uh 125 and zero Southbridge Road.
8:59 | This J.
9:02 | Um so this property is owned by um Otus Land Management and also New England Power is on the other side of the property line. This is the uh old
9:09 | Eddie's Auto site. Ralph Nichols owns it. Um so on the property line or over the property line on the New England
9:16 | power easement um over the years from pushing snow and millings has gotten pushed over the banking or over the property line. Um so he's proposing uh
9:25 | national grid is is kind of pushing this to uh remove that fill that's been pushed over the property line. So we
9:32 | have erosion control shown at the at the base of the slope and he's going to be pulling that back from up above with a with a you know big esavator. Uh he'll
9:41 | load that in the truck, whatever fill he takes out, get back down to natural material, and then he'll reloom and and recede and stabilize um the slope once he's completed.
9:51 | [clears throat]
9:52 | There's no construction being proposed.
9:54 | Yeah, there's no buildings or any additional parking or anything. You have any issues with it? I do not. Anybody in the board have any questions?
10:01 | Are they doing anything to prevent it from happening again? Um yeah, he does have uh some proposed barriers that's going to be there so
10:09 | they can't like either um telephone poles every six feet or like some um jersey barriers or something. Yeah, they did that actually once they noticed they
10:17 | were doing it. They put something up last last winter. So, anybody in the audience have any questions?
10:26 | Everybody's quiet tonight.
10:29 | We're just uh closing this closing issuing. I need them. Motion to close the hearing and issue with auto conditions.
10:38 | A second. Second. All in favor?
10:40 | All opposed? The eyes have it. 18 Oxbow Road.
10:45 | Uh we're opening but we'll be continuing it to September 9th.
10:52 | Okay. I need a motion to continue the hearing. Motion to continue. I need a second. Second. All in favor? I.
10:59 | All opposed? The eyes have it. Lot five Smith Road. Thank you.
11:08 | We don't have a DP number. We'll be continuing it. I need a motion. Continue the hearing. Motion continue.
11:14 | Is there anyone here for Smith Road? Okay. I need a second.
11:22 | All in favor?
11:23 | All oppose? The eyes have it. 70 Beach Road. I'm sorry. Can I just have that plan? I'm sorry. It's okay.
11:34 | Beach Road, do you mind stepping in so you can address the commission? Thank you. Can you hear me?
11:41 | Over there. Yeah. Who would you like for me?
11:52 | Just explain the commission. What are you proposing to do? Oh, okay.
11:56 | That's all. I have a uh a 42 foot deck and underneath the deck there's a 70
12:02 | year old piece of uh cement work that's deteriorating and it's actually D. The reason I'm doing it over is somebody's
12:11 | going to get hurt. So it's directly underneath the deck. It's 14 by 40 and I'm going to replace it with pavers.
12:20 | That's the extent of the activity. But he is within 30 ft from the lake. So we had to fight and we just have a little
12:29 | drawing. He had a picture here. I don't have Do you have a picture with you, Chase? For some reason, it's not on my folder.
12:42 | On gravel. Say it again. He was going on gravel. You can't ask him.
12:59 | Replacement of existing 42x4 concrete patio with tackle block miss.
13:08 | That's the blocks that can be used, isn't it? That's it. No.
13:14 | Oh, okay. Um, do you know if they will be having uh the pavers are going to be on top of gravel or it's going to be straight to the ground?
13:23 | Yeah, he it's it's a reg he's he's Vinnie zoning. Yeah.
13:28 | And he's he's going to put a a base underneath it. Great. And put the pavers under on it.
13:34 | Okay. Does that answer your question? Do you have a question?
13:41 | I said I know Vinnie. He does a good job.
13:43 | Yeah, he does. Yeah. Anybody else have any questions on the board?
13:49 | Anybody in the audience have any questions? Where we headed?
13:55 | I just close the public hearing issue the order of conditions. Okay, I need a motion. Motion made. Second. Second. All in favor?
14:03 | I. All oppose.
14:07 | Close the hearing with an order of conditions.
14:12 | So, um, we we issue you the permit and then you have to have it recorded at the register of dates and then once that is done, you
14:21 | let their office know and when it's time to do the work, you call me so I can go check the controls. You're going to put it down. Oh, okay.
14:29 | And that's it. You just need to let me know before you start. The the document I got from the state.
14:34 | What is that? I Excuse me for my Yeah. No, that was just communication within you. I don't know what document you
14:41 | say a uh it gives a um a project has been assigned with the following CE number D number. Yes. So Oh, that's okay.
14:49 | Yeah. No. Yeah, that's just part of the process that that's the number with the commission needs to issue the permit. Okay. So that's it's good to go.
14:57 | Good to go. Okay. So the next thing I have to do, Rose, is what?
15:01 | Uh they will call you when the permit has been issued my office. Oh, okay.
15:06 | Yeah. And you come Yeah. You come to pick it up the order. Okay.
15:09 | And you have it recorded at the register of dates. Oh, okay. In Worester. Yeah. Thank you everybody. Yeah. Good night. Thank you.
15:18 | Never did this before. So, [laughter] five Roberts Boulevard.
15:26 | Thank you all. Yeah. Have a good night. Thank you. That sounds familiar. How are you?
15:35 | Good.
15:36 | Do you mind just letting the commissioner what you're proposing?
15:39 | Um yeah, we're looking to build a 10-foot raised deck um extending from
15:45 | our home and it's within 100 feet of conservation a lake.
15:54 | They're within 70 feet from the shoreline and they're using Are you using technopost?
16:01 | No, we're going to use um we're going to dig it big feet with the Bigfoot with the sound tubes. Oh, the son tubes.
16:09 | Yeah. Yeah, sona tubes. Yeah, that's what I meant. Sorry. Yes.
16:16 | Just out of curiosity, what size is he having you use on the sonnet?
16:21 | I'm going to use 12 inch. I overkill everything.
16:24 | It takes a lot of concrete mixing by hand.
16:26 | I know. I'm going to get a mixer as well.
16:31 | Anybody have any questions? Any questions in the audience?
16:35 | Your recommendation? We can issue a negative determination. I need a motion. Motion. Second.
16:44 | Second. All in favor? I. All oppose. The eyes have it.
16:48 | So, we'll call you tomorrow and issue the permit. There's some conditions just to make sure before you start the work signs are posted, erosion control is
16:56 | publicity and just let me know before it starts. Excellent. All right. All right. Of course. Yeah. Have a good day. Can I have that background?
17:04 | 40 Carol Hill Road.
17:21 | So this work consists of a crossing uh of the BVW and they're just conducting a
17:29 | pork test. So they'll be coming back with a notice of intent for the construction of a structure. I'm not
17:37 | sure what they're building there, but for now they just requesting a permission to cross the wetlands to um conduct the test.
17:45 | So just a negative just if you would like to know location, but right there but it's just a negative determination. So they see that.
17:53 | Yeah.
17:54 | So they can drive over the wells and go to the uplands to conduct the test. used to be a big farm. Are you familiar with that area?
18:02 | Are you familiar with that parcel?
18:04 | I don't know. That's what I'm looking Oh, okay.
18:17 | [clears throat]
18:19 | The person appeared. Wasn't there someone? So, he's in waiting again.
18:29 | Oh, how is that possible?
18:30 | He must have had issues and left and come back. Okay. Oh, it's too late now.
19:13 | I need a negative termination.
19:20 | [clears throat]
19:20 | Need a motion. Motion made. Second.
19:23 | Okay. All in favor? I all oppose. The eyes have it. Certificate of compliance 59 frame metro road.
19:33 | Uh yes, complete certificate of compliance was uh related to a septic system. I can barely hear you.
19:40 | Septic system uh installation. I was uh recommended complete certificate compliance. I need a motion. Motion made. Second.
19:48 | Second.
19:49 | All in favor? [clears throat] All oppose? The eyes have it. Six Lambs Pond Circle family lot too.
19:56 | Yeah. Construction of a single family home back in decades ago. Complete certificate of compliance.
20:03 | I need a motion. Motion made. Second. Second. All in favor?
20:09 | All opposed? The eyes have it. 21 Bracket Hill Road Lot 26.
20:14 | Yeah. Uh construction of a single family home. I would recommend a complete certificate of compliance. I need a motion. Motion made. Second. Second. All in favor?
20:22 | I. All oppose. The eyes have it. Enforcement violations 103 Bond Road.
20:28 | Uh we issued this enforcement order. Uh we just need to ratify today at the
20:35 | public hearing. This was related to uh we approved the order conditions for the construction of the tower uh cell tower
20:44 | uh and there was an existing uh wellin violation. So the well in violation is being uh remediated under the
20:51 | enforcement order and the order conditions was just for the project. Uh so we just need to ratify the enforcement order which we can sign towards the end of the meeting.
21:01 | So what kind of a motion we looking for? Uh motion to ratify. Motion to ratify. Need a motion to ratify it.
21:08 | You have it. Second. All in favor? All oppose. Tom, do you mind just excuse me?
21:18 | We clo we we continued that was uh 15 minutes ago.
21:24 | We continue the public hearing to September 9.
21:30 | Everybody else has continued to I was like number eight on the list.
21:35 | We go in order. So whoever there was no GP number everything got continued.
21:43 | So, September 9th, you did request for the Zoom link. I
21:53 | actually was expecting you via Zoom. So, we waited a bit to see if you would pop up. It didn't show up. So, I wanted to talk about a waiver.
22:01 | Yeah. Well, September 9th. Thank you. Yeah. Water road.
22:11 | So, uh, we issued the order conditions DP number 128 2013. Unfortunately, there
22:18 | was a fire in the property owner's, uh, vehicle and the order conditions was in it.
22:24 | Oops. [laughter] It's like the dog ate my There was some left, but I don't think he'll be able to record it that way at the registry of D. So, I would like a
22:32 | motion to reissue the order condition so he can have a record. I need a motion. Motion to reissue.
22:37 | Second. All in favor? All oppose. The eyes have it. 24 Sturbage Road.
22:43 | As you all have uh hopefully received my emails related to uh
22:51 | a violation of our storm water bylaw and regulations. I just want to bring it to the record. Uh on July 21st, 2026, IG
23:00 | witnessed a site runoff associated with an unpermitted site activity in Grady at the property located 24 Ridge Road, a
23:08 | budding 17 Griffin Road. Um I verbally request the property owner to cease the activities and reminded him that the
23:15 | activities were unpermitted. He chose not to.
23:20 | On July 22nd, I witnessed a second site runoff as a result of the continued activity. On both occasions, the runoff
23:28 | extended to Route 20 in entering state drainage and resource areas and eventually discharging into Katy Brook.
23:36 | Although sedimentations were not witnessed entering Katy Brook, uh Katy Brook is a protected state cold water fisheries resource and sedimentation
23:45 | runoff into the brooks a violation of a Massachusetts wetlands protection act.
23:49 | Given the amount of disturbance uh they're also subject to u EPA permit
23:55 | [clears throat]
23:55 | according to the website one was u permitted and approved effectively in March. However, I have some Google image
24:03 | that were looked at it and lane disturbance activities appear to have commenced in 2019 and continue through
24:10 | the present time. So, the NPDS uh was not found for that period.
24:17 | Additionally, a letter of violation regarding land disturbance activities was also issued to the property owner back in December of 2022 in November
24:26 | 2025 informing that the town of Charton uh storm water management rules and regulations and requesting him to cease
24:34 | the operations and file for a permit. A fine then was issued for $300.
24:40 | A lane disturbance permit application was actually filed in 2026 but was denied due to lack of support and documentation.
24:50 | I did let you know that he as he should be aware chapter 175 storm water management applies to all land disturbing activities that result in
24:59 | lane disturbance of 43,560
25:01 | [clears throat]
25:03 | square ft or more and a permit is required prior to any regulated land disturbance activities.
25:11 | At that time of this letter, I also asked him to immediately assist and decease the activities pertaining to any alteration, construction or repair of
25:19 | the parcel. I did advise him that any person who violates the provision of the bylaw, regulation or order or permit
25:28 | issued there shall be punished by a fine of no more than $300 a day. Each day that the such violation occurs or
25:35 | continues shall constitute a separate offense. I have to date five fines
25:41 | issued to him. He did not agree to stop construction.
25:47 | Uh eventually I stopped uh going to the site to verify if construction was continue or not because the situation
25:54 | became a little bit um what's the location of 24 24 um right [clears throat] off right off Route 20 right next to Griffin Road.
26:04 | Right. Yeah. So you pass Griffin Road and they is that large lot where there are solar there are a lot of activities going there.
26:14 | Yeah. So so he hasn't complied with the he continued construction without a permanent any storm water management that I know any site plan.
26:24 | It sounds like this has been going on for years.
26:26 | It has. Yeah. So the town is engaging into counseling now. So we'll be having to go. I just want to let the commission know where we stand.
26:35 | Yeah. If you have any question. Yes. I tried.
26:46 | Any question? Anybody have any ideas?
26:52 | I could continue issuing a fine every day. It would be up to, I don't know, 20 at this point. I don't know.
26:58 | Construction has stopped. He did uh acquire Mccclure engineering to now um be his engineer. He does have to go in
27:06 | front of planning board because what he's proposing to do there requires an approved site plan from the planning board. And at that time we were actually
27:15 | going to know what has been done without the permit if any storm water manage has been um
27:24 | installed. has given us any subst substantial reasons for not being he does not want to stop and it's his
27:33 | parcel that was the pictures I sent it to everyone yeah was not
27:40 | meeting tonight uh it was uh no
27:53 | that's a
27:55 | [snorts]
28:02 | When was this that last heavy rainfall that was going Yeah, that was a couple days in July which has been resolved. He was in the
28:10 | middle of construction and you know we do have runoffs in the middle of construction. Sometimes we have a flash rain and it happens. But the that wasn't
28:19 | the problem is that he was disturbed without a permit and he continue disturbing and grading and
28:27 | um to date. I don't have any pictures of the site itself. As I said that not welcome there at this point. So we're
28:34 | waiting to hopefully um Mccclur will be submitting something to us. It's all stable now.
28:42 | I don't know. Again, I haven't been there.
28:46 | Let me get you a camera with a tele so you can be like that.
28:49 | There has not been any additional runoff since after those though.
28:56 | We haven't had substantial rain like that since then either, have we?
29:00 | Yeah, but at this point, the last time I was there, part of the parcel was already paved. So, I I do not foresee an
29:08 | additional runoff. is just the fact that he's just [clears throat] not he disturbed without a permit. Yeah.
29:14 | Changed the grade.
29:20 | So, I'm hopeful that something will come up in front of the board uh uh the planning board so we have an idea of what
29:41 | the only issue is storm water compliance [clears throat] like there's are there wetlands or anything there on that parcel? He's outside the 100 foot buffer of the wells.
29:49 | Okay.
29:50 | Yeah. Just the runoff affect the wellins outside offsite. Gotcha. Yeah. And it's up state highway basically.
29:58 | Yes.
29:59 | So state highway was notified, DP was notified. EPA was notified.
30:08 | Have any of them responded? No. Where all this go? The drain.
30:13 | It goes to Route 20. State drainage across the street. Wetlands Katy.
30:32 | It is a first. have got resistance but not to dislike.
31:22 | Thank you. You're welcome.
31:26 | All right. Conservation Commission meeting time change. We brought up a few meetings ago if the commission will be willing to start our public hearings at
31:34 | 6:30 instead of seven. If anyone has had any more thoughts or would like to make a motion to make a change or make a motion to do not make the change.
31:43 | A motion at 6:30. 6:30 to 6:45. Yeah.
31:48 | I can't I can't approve at the time, but
31:52 | [laughter]
31:53 | 6:30 6:30. Okay. Thank you. Does it work for everybody? Does it work? Yeah. Okay. All right.
32:05 | Last one. Wig surfing bylaw discussion. Yes. To do.
32:11 | So, I have been sending to the commission uh numerous uh emails of residents
32:18 | uh and uh either from the lake or surrounding lakes that are supporting uh the bylaw.
32:25 | Uh there was a draft that was presented to the conservation commission. So to make sure everyone's on the same page,
32:33 | uh the commission would make a motion when time comes to support the bylaw. So that is sent to
32:42 | the board of select men who then will make their decision whether or not they're going to be approving that uh
32:48 | and bringing it to a town meeting. So what we have in front of us right now as
32:56 | most [clears throat] of you or hopefully all have seen uh findings and u researches and peer reviews of the
33:05 | detrimental impact of the activity that has been proposed to be ceased on South Cha reservoir. I
33:14 | don't know if you have any questions about anything that has been submitted.
33:18 | Uh the residents I'm assuming are here for that purpose.
33:24 | South South Charlotte reservoir is a closed lake, right? And there's no public if it's open for the it's there's no public there's no public access.
33:34 | Isn't this for all the ponds and lakes?
33:35 | Yes, it would be for all the lakes in Charlton.
33:38 | Y all the lakes that could support that could support.
33:41 | Yeah. And at this time, South Troutton Reservoir will be just number one given the size. I don't see it the sport being
33:51 | tried. May maybe Glenn Echo if someone What kind of feedback are you getting on the other lakes like on Glen Eko?
33:57 | We don't have anybody that does it on Gleno.
33:59 | Nobody has We don't I don't think we have enough depth or width on that lake in order to support it
34:07 | as it is. You know, you can it it doesn't include watercape. No, it's just the wake surfing.
34:14 | Does the commission have any question of what it relates to the either the damage it causes or do you have any any
34:22 | question at all that I might answer or the public may the only question I might have is who keeps track of what damage has caused
34:29 | over the years or does anybody have any statistics on that or
34:35 | there are research out there um the way that you could see that is But it's when you have enough invasive species.
34:47 | So as the the the the liquid yeah gets uh eroded by the activity. So
34:57 | if let's say we have what is it variable mil foil or fan worth?
35:01 | Yeah. Or fan worth. It gets destroyed in the process of the activity and it carries on throughout the entire lake.
35:08 | It it spreads. So the invasive species does spread along.
35:13 | Is there a whole lot of wakeboarding on South Chelton? I believe what is the question? Two boats. Two boats.
35:19 | Two boats. It's wake surfing the two things. Yeah. Two boats over the summer.
35:27 | I don't know how often. I've been on 15 times this year. 15 times. There we go. We have a number. Thank you.
35:34 | I think I read in the paper that one family bought a home over there. I'm sorry. VA. Yes.
35:40 | That one family bought a home over there that for the purpose of Yes. having a place of wakeboard. I have heard that. Yep. Yep. Yep.
35:49 | How how deep is it?
35:51 | 40t off the shore or 50 feet off the shore.
35:53 | Right. And so and that's the point I'm trying to make and that's why I put it on the agenda to be a discussion. I
36:00 | although we have you know all this uh information provided to us with uh
36:07 | online searches and peer reviewed and things that have been happening in different states or in different lakes.
36:14 | Uh I don't I don't know for certain the death of the lake. I have numbers here and there. One came from a bathematic
36:21 | study that was done few years ago. It was not submitted to the tower and I got that actually I was surprised that it was out there that shows
36:31 | uh the the the depth of the lake in different um areas because clearly a lake is death depth is not contiguous.
36:42 | Yeah.
36:42 | So who's going to be responsible for saying that the lake is deep enough 15t?
36:48 | That's what she's that's what I'm trying to get to. Yeah.
36:51 | So, we can go back to the discussion, but since you asked the question, I feel for the commission to make a decision,
37:00 | it would be important for us to have a peer review that was made on that lake
37:07 | itself. a well-in scientist who is familiar with the lake who come up with the death of the lake the locations of
37:15 | that death and any detect that he believes it could be occurring from that. Can we pass this off to the selector?
37:22 | We may not make a decision.
37:24 | No, it will we will pass select me if we if we support it but if we support we
37:31 | should be giving enough background information to support the bylaw. So it would be um well actually it would be on
37:40 | the lakes and funs. So we have what's called a um waterway what is it called?
37:46 | You asking me now I know municipal waterway funds where funds are there for uh treatment and maintenance and uh anything that's
37:55 | related to waterways water um regul not regulation but improvements improvements. So many are there many wetland scientists
38:04 | around that have all the information for all the lakes the depths and well we would be requesting proposals.
38:11 | So would they pass in those proposals to the licks and pon committee and if they approve that they would hire a
38:18 | specialist and a professional who then come back to the commission with information that it will support or not
38:27 | support this bylaw but that is just directly taken from south chton reservoir. So I think it's important for
38:34 | us before making a motion or pass this over to the select man. I don't know if people what happens if it's not supported by this board.
38:43 | It doesn't go It doesn't go to the governor.
38:48 | Isn't there already laws in Massachusetts?
38:51 | Not for not for Not for for There's two different things. Wake surfing and wakeboarding are two different activities.
38:57 | Wake boarding, right? And then then it goes on [clears throat] to give you where surfing would be prohibited.
39:04 | But it's not I don't believe there's a state level law. and they ask for additional studies.
39:14 | Right. Right. Right.
39:15 | And that's what we try to do with we really like to have some more information. I mean the the we can't deny that the studies are out there. We
39:24 | can deny that it is detrimental but we just don't know if South Charlton could support supports that or not. And I would hate
39:33 | to make a decision whether positive or negative without having, you know, a specific.
39:38 | Have you heard from many people on South Trland in response to this? I think they're all here. Yeah.
39:47 | I heard we have two people here, but another one. Yeah. Yeah.
39:51 | Oh, they're they're they're all what it mean. They're all residents of the lake.
39:54 | See, seems to me that it would [clears throat] be much worse than water skiing. It's the Well, the difference is the the effect on the bottom of the lake versus water skiing.
40:05 | I can make a pretty big wake on
40:06 | [clears throat] when I fall. [laughter]
40:07 | That's a wake, but that's surface water.
40:10 | We're talking water down the depth going down 20 ft.
40:13 | Isn't that where Excuse me. It's the same as one ski, isn't it?
40:16 | No, wake surfing. You don't even you're not even holding on to the boat. It creates such a big wave that you actually surf on it and it can move the wave back and forth.
40:25 | That boat can wake boarding is a it goes faster. has a different size wake. [clears throat] There's different nuances to to each activity.
40:34 | Is there a certain speed where boats could go with a wakeboard and not disturb?
40:38 | So, it's two different things. One's wake surfing and one's wake boarding. We're talking about surfing.
40:42 | We're talking about wake surfing. That's a very slow moving boat that generates a plume downwards to create a much bigger wake.
40:49 | So, you can still wake board or tow a tube around water speed. Yep. And that's a much smaller wake. Can this generalist have
40:59 | some comments that [clears throat] I'd like? Yeah, of course. Yeah.
41:03 | I just want to make sure that you have all your questions so we can discuss. How does a board feel about it?
41:09 | Well, I read a bunch of things about depending on the ballasting of the boat as well. That true high pressure pushing down as well as how deep the boat is sitting in the water.
41:19 | True.
41:20 | Um depends also on the disturbance on the on the pond bottom. And a lot of places are
41:26 | looking now to even move it from this um 300 feet from shore and 15 feet of
41:35 | water. They're looking to move it to uh 600 ft from shore and 30 feet or something and 30 feet of water.
41:42 | They're making it really deep.
41:44 | So to be less disturbance for not 30t.
41:48 | Correct. Correct. And that's Yeah. And that for effect for the shoreline erosion which is right 600 ft
41:55 | which in retrospect I mean every activity on the lake impacts shoreline you know even if there were no activities on the lake would have
42:03 | shoreline erosion it's just natural it just happens. Has anybody ever wake surfed up at?
42:10 | No, nobody nobody has.
42:13 | They wakeboard. We too. We do everything else, but nobody has no wake surfing has come through.
42:20 | Let me see what this gentleman has to say. Sure. If you don't mind. Yes. I have something. Do you want me to pass around? I only have six copies.
42:28 | It's sufficient. It's okay. We'll share. We all work together.
42:33 | [clears throat]
42:39 | Just a memorandum with some information that I want to provide.
42:56 | Just your name for the record and address.
43:01 | Let me give everybody a chance to look at it first. Sure.
43:10 | Is there a deadline? Uh, no.
43:17 | [clears throat]
43:22 | I'd put it under consideration for that's I think that's
43:34 | So is there anyone here who has who has the vote? So are you Yeah. Can I ask you a question?
43:43 | So uh and that's just some I'm just curious about it. So let's say we have 22 feet depth at some part of the lake,
43:52 | which I believe we do in some area. So once you're going, you know, on a straight line, do you turn around it? Do you stop the boat? How do you go back?
44:02 | So I don't know if you're familiar with South Reservoir, but we have a really wide part of the lake. Yes. Okay.
44:08 | And that where the slalom course is where the guys go through with their with the um with the water skiing.
44:15 | Okay. So we, Joe and I, we stay in that wide wide section where the water is the deepest. We go straight down. My
44:24 | daughter surfs all the time. We go straight down. We stop again before we get anywhere near the shore. We turn the boat around.
44:32 | Do it again. That was the question that we had.
44:34 | Yes. And um yeah, that's it. Thank you. We just was curious.
44:40 | So, so there's no the question the reason I asked I was interested to know if they would do a U-turn, you know, where they would go and probably he uh
44:48 | lower uh uh yeah a more of a shallow which he doesn't. [clears throat] It appears he stops the ball and then he turns it around.
44:57 | Now, we're planning on hiring somebody to that would be my recommendation towards the end of this discussion. Uh
45:05 | so we can, you know, be actually talking about it. uh with with undisputed facts kind of right
45:13 | and scientific data from our own lake versus you know different lakes around the state.
45:19 | So if we have a peer review it's not proof positive. It doesn't lock us into one way or the other.
45:25 | No the commission still have the the the the decision to make whether you support the bylaw or not.
45:31 | I don't have a host in this race but if I was on the lake I would want to use it the way I'd like to use it. fully preparational.
45:43 | Yes. Go ahead, sir. If I might. Um, my name is Jim Triplet. How are you, chairman?
45:49 | Um, I've submitted part of a document that um was actually part of a package several weeks ago. I was here and submitted a number of studies that were
45:58 | done outside the state. I heard the question asked earlier if Massachusetts has any kind of law on it. It's relatively new. So aren't weight or
46:06 | surfboarding boats. Um to answer that question for surfboarding boats are designed with ballast tanks in the back
46:14 | so that they create weight that actually creates these big waves bigger than w bigger waves than is what is would
46:22 | normally be generated from any other kind of boat. And the purpose is so that per people can surf on these waves
46:29 | without water scan just like you would in the ocean um behind a boat. Um, the studies, in case any of you haven't read
46:37 | them, are pretty consistent about the types of restrictions that are necessary in order not to create significant
46:46 | ecological negative impacts. Um, both the wildlife, fish, um, plants,
46:53 | everything. South Charlton Reservoir happens to be one of the bigger lakes probably in Charlton. Um, as you
47:00 | probably know, historically, these lakes are all pretty much man-made. There might be a couple of because they were set up so that uh mills could operate
47:09 | and and run historically. So, generally, they aren't that deep. And what I've done for you tonight is, and it's not a
47:17 | scientific study, it's using a calibrated rangefinder, but I wanted to bring to your attention that the
47:24 | statistics show that you really need about a minimum of 20 ft of depth so that it does not affect the ecological
47:33 | system of the bottom of the lake. And you need about a minimum of 400 feet in order not to affect the shorelines for
47:42 | so that the waves can dissipate and not affect erosion. Fish
47:48 | uh fishery places um nesting places for for birds south reservoir. You can see from what
47:57 | I've submitted there, um, an informal study was done in which, um, a boat with a rangefinder went down the
48:05 | middle of the lake. Now, Saltron Reservoir has a wide point. It's not that wide. It's wide, but it's not that wide. And most of these gentlemen do
48:13 | their wake boarding not in the middle where it's wide as some of it, but mostly down in this area where they talk about the slalom course. Now, I've lived
48:21 | I've lived on the lake for over 50 years, done a lot of water skiing, done all the things that people generally do
48:27 | on the lake. Um, the waves are huge and they [snorts] create significant impact on the shore. And if you're in the
48:35 | middle of the lake where they generally do it, first of all, from the opposite shore, I don't believe it would be a minimum of
48:43 | 400 feet that all the waves are crashing into the shore. Maybe if you're on the opposite side, it's 400 feet from where I'm located, which is generally where
48:50 | they do the the the wake boarding. So, what we did is um we took a group of people and went out and did the
48:58 | measurements on the bottom down the middle of the lake because that's about where the average is from both the widest point and the most narrowest
49:05 | point. And what you will see is that the lake averages no more than 10 feet deep in any one location across the middle of
49:14 | the lake. So that in itself um creates a What do you mean by I'm sorry I don't mean to interrupt you. What do you mean by average?
49:22 | Well, you you'll see there's 22 pieces of paper that were attached to my memo that I gave to you. Yeah.
49:27 | And and in it, I explained to you that the measurements were taken at 22 different locations.
49:33 | If you look at the first page, it shows an actual map of the lake together. You're getting about 10 ft. Yeah.
49:38 | And it shows where the where the measurements were taken. And then every 500 feet down the lake, a measurement was taken of the depth of the lake down the middle.
49:50 | And you can see each of the measurements over that 22 measurements each about 500 ft covering the entire course of the lake.
49:57 | And and the the lake is like a I'll call it an amoeba. It it's narrow at one end, it widens out, and then it narrows back down at the other end.
50:06 | And again, the average I didn't actually average them out, but the the biggest depth is um about 12 feet across the middle of the lake.
50:17 | The deepest that's about the deepest point and the average it goes as little as 9 ft up to about 12.3 feet or something like that.
50:27 | Now, I suppose there's a location where there could be a hole in the in the lake where it could be 20 ft deep, but that would be one location. And, you know,
50:34 | over the course of the average, again, it's it it just doesn't it just doesn't meet the standards of the studies. And I'm only saying this because the studies are very very clear.
50:45 | Whether you look at Michigan studies, Vermont studies, uh, New Hampshire studies, any of the studies, they all are pretty consistent with what's
50:53 | necessary not to create damage to the environment. based on these work these boats and I know you made a mention of
51:00 | of the boats you know people enjoying it but these boats are designed to create these waves that have extra power because of the way they're
51:09 | designed and that in itself is what c you'll see if you read the studies that the board has that the waves themselves who are that have been scientifically
51:18 | analyzed create significant power to create ecological damage as opposed to the regular skiing boats which they
51:26 | found doesn't really do that. So, I just I think it's a wonderful idea from my own individual perspective that
51:33 | somebody's going to actually commission a study to do this because or at least do the measurements because I think that will kind of resolve the problem. And of
51:42 | course, I would invite the board to look at the studies if you haven't because it's pretty it's pretty it's pretty alarming.
51:49 | Does does the boat speed have anything to do with it?
51:53 | Well, when you do these surf boats and these gentlemen and ladies can speak to it more than I can, but the boats generally are going a very because you can't create the waves unless you're going slow.
52:02 | Um, so it's generally a very slow moving boat. Um, and that's what creates the waves.
52:09 | All right. Did you want to get up and say something? Huh? Please. I got to give you an opportunity.
52:19 | You can just step. We're going to have to step in though. Yeah.
52:22 | I mean, I know many of us shared our thoughts. position and I do encourage you all to there are studies I've seen
52:30 | them they're on different types of lakes you know different environments but I encourage you to read the studies of the
52:38 | you know where they aren't really sure if that much distance is necessary 200 feet is where most states are landing
52:47 | Massachusetts is doing 300 feet and 15 or sorry 300 feet from the shore 15t feet. So, like we really have to look at
52:57 | all the numbers and that the studies I've seen the ones with the 500 ft.
53:02 | They're different lakes. It's a different makeup. And you also have to look at Yes, I'm not going to argue it's a it's a big wave, right? I'm not going
53:11 | to argue that. But how much more damage to the environment is that doing than everything else on the water and what everyone else is doing? not 300 feet
53:20 | from the white like they're they're along the side of the shore like they have no restrictions. So, I'd like to see the study, of course,
53:28 | if you're going to do it. And I think that that study should show how much more of an impact does our two boats do.
53:36 | And that's why I wanted it to be tailored to our lake, right? Yeah. We want to be fair everybody.
53:42 | Yeah. I mean, and I would like to have comparison.
53:46 | There's two votes that we're spending this time on and appreciate the study and and yeah, I thought it was a good compromise
53:54 | before anyone makes a decision. So, uh, comparance with existing
54:03 | water activities which is not restricted. Is there a restriction for jet skiing or
54:10 | the speed limits and how close you can be to shore when how close can you be to the shore? Yeah, that's that's Do we have anything?
54:17 | Are there any other lakes in town that are in question or No, probably not even close.
54:22 | The other thing is these boats won't run if the water's not deep enough. Like we there's spots on the lake that you can't get away because it's not deep enough.
54:29 | Like we know that.
54:31 | So it's kind of a self- selective the lake decides if it can operate or not. So you have more.
54:39 | So I have a question and again yes might be irrelevant. So, as you just said that, how do you get the boat from
54:47 | a shallow area out to a deeper area?
54:52 | We go to the deeper area and we start there.
54:53 | Yeah. They putter out. They don't They don't power up from there. Yeah.
54:58 | This is just like a regular boat that there's hundreds of them on the lake.
55:01 | Okay. It's the same exact type of thing other than ours. We can put weight in it to lower the the back end and create a wave. Got it.
55:09 | Um I do have a question. So let's just say this does pass. Does that go for every lake in childhood now? That's the way it's written and and that's the way it is written and
55:18 | then but before that happens each leaks association would have to support the bylaw as well because it'll be affecting
55:27 | everyone right so there's a lot of work to go and we have to be very careful whether which direction we go because it will affect everyone
55:34 | right because those other people don't know about this and there's other lakes and challenge so I mean who who's going to be doing the enforcing
55:42 | and that's all the issue that we have to into the bylaw.
55:45 | It would have to go into the bylaw who will be enforcing saying what the fines would be or whatever.
55:49 | Yeah, that's South Carolina reservoir doesn't even have a town way to water. No, I'm sorry. Have what? A harbor.
55:57 | Doesn't have a town way to water. A town ramp. We we have a boat ramp, but it's locked.
56:03 | I mean, public can have access to it, but they have to ask certain people for keys.
56:09 | So, we we have that we have that lake categorized as not public. It is not public.
56:15 | I don't see any that's I think that was some type of commitment that the town
56:22 | made when that dam was repaired that residents would be paying a certain amount for the dam repair but
56:30 | other outside boats would not be allowed there.
56:34 | You order to you know conserve the water quality and the invasive species and
56:41 | everything else. That's the information I have.
56:45 | I'm I'm going to beg to differ with that a little bit because of its size. It is a It's not a private lake. It is [snorts] not a private lake. It's not a private lake.
56:53 | It's not public.
56:54 | It is subject to enforcement by both the town of Char police and the environmental police.
56:59 | Yes, that's true. But for residents to live there, right? And I believe the deal was is that the town was going to open it up to
57:08 | absolute public access if the town was going to pay for the Correct.
57:13 | If everybody was going to pay the assessment privately around the lake and they would not open it up and put a correct public a big sign. Correct.
57:23 | But I believe and correct me if I'm wrong over where the dam is, which is the spillway. I believe that is town of child property. Yes.
57:31 | So there could be a boat ramp put in there if but we don't have one. So we don't have one. There's none at this. So the fact is correct.
57:39 | [clears throat]
57:40 | So if the town wanted to put a boat in there, say if the assessors wanted to go out in a boat, when I was an assessor, we used
57:47 | to take a boat out on Glenn Eco and look at all the property, see it was doing what? Yeah.
57:52 | How would they get a boat onto We do have a boat ramp.
57:56 | It's just locked. They Yeah. Yeah. Can you come see me? I have a key. Yeah.
58:01 | What's the difference of water skiing off your dock, getting pulled off your dock?
58:05 | There's nothing or two skiers. Your boat's doing the same exact.
58:09 | I've actually done that before. I know you're right.
58:11 | It's not the same. It's not the same activity.
58:14 | You have all your children, grandchildren, nieces and nephews, and there's 12 people on a pontoon boat. You're pulling a tube around. Everybody's having a good time.
58:22 | You're still
58:33 | weighting. I put 2,000 lbs of weight in my boat to go surfing.
58:38 | to go wakeboarding. It's the same weight foiling and doing the same exact setup as surfing. There's nothing
58:46 | restricting that. [clears throat] Yeah, it it seems like if if you know this passes then what's next? Is someone going to get upset with the water skiing
58:54 | and then that's going to end? And you know then where where are the limitations for water skiing as far as shoreline? Is there certain distance?
59:03 | 150 ft from shore. 150 ft from shore.
59:06 | People still starting up all that been doing that historically.
59:11 | Oh, historically I'm aware of this key back in closer to right to get person closer. Yeah.
59:17 | So, at the end of it, so I work full-time. My son works full-time. We all work. Like I said, I've gone on and I counted this year. We've gone on the boat 15 times.
59:27 | Wake surfing. We go on the boat many times, but wake surfing. Gone on 15 times. It's maybe an hour, maybe less.
59:34 | My wife goes, does a couple runs. she's done. I go, couple cup runs, done. My daughter goes, couple cup runs, she's done. That's it. [clears throat] We're done. And then we go cruise around the
59:42 | lake like everybody else. We don't abuse it. We try to do it the best way possible in the widest part of the lake.
59:47 | We respect everybody. If we go out there, there's pontoon boats out there cruising around because it's a beautiful night. See you later. We turn around, we go home. We don't we we're not a problem. We we just enjoy doing this.
59:58 | It's a full recreational lake. So, we enjoy doing it and we and if there's any issues, we stop water skiing clubs on Monday and Wednesday night. We never go out. We give the lake entirely to them.
1:00:09 | Does uh does Webster Lake have uh that type of voting? They do. They do.
1:00:13 | They're in the process. They're in the process now. Yeah.
1:00:16 | Lakewood Sigman, same thing. In the process. How how deep is Webster Lake? It's deep. Very deep.
1:00:21 | And Lakewood Sig's 82 feet deep at real deep.
1:00:25 | But a lot of cars. And then but you know the shallow points as well. That's got a false bottom on it.
1:00:32 | How deep is Perpoint?
1:00:34 | Oh. Yeah, that will be now one of the I'm going to get somebody to Yeah, I think we should just pursue study for us. Do the study first.
1:00:42 | We have an independent. We want to be fair. That would be my recommendation. All right.
1:00:47 | Uh I have just two residents who like to have a a word if you don't mind. And I'm sorry, sir. Your name? Dennis.
1:00:54 | Dennis. Dennis. Can can I show you this picture if you don't mind?
1:00:58 | Can you show me where the area is that you see and where you turn? right here.
1:01:05 | So, this is the Is this um bring it over? You can bring it over and
1:01:13 | work there. Just put a dot for me where you turn because I think Joe's house is here. I'm in the cove. My house is here. Cove.
1:01:20 | This is where we go. Right here. Is it a straight line?
1:01:24 | Yeah, we just go right here. So, just if we turn, we would like go like this. We don't go past the boat, the ski ramp.
1:01:31 | And just so everyone knows, this is all woods. So we take our we do have a big wave and a smaller wave. So we take our big wave, we put it into the
1:01:39 | conservation [clears throat] land where there's not one house. It's all trees.
1:01:43 | It's all rocks and and you can see it clearly on here. This is where we concentrate on our surfing.
1:01:48 | [clears throat] We don't ever go past there. There's a boat ramp right here for the water skiers. We don't ever go past that room because that see how narrow that is? We wouldn't because people would go crazy.
1:01:58 | We ended there. Yep.
1:02:01 | Is that fair? Just that is completely fair.
1:02:04 | Okay. Do you mind looking I just want to I have I have two points to make relative to that. Yeah, of course.
1:02:10 | He's kind of making our point relative to the distance to the shoreline because he's he's correct that on the opposite side
1:02:18 | actually it's across from where I have lived for 50 years.
1:02:22 | It means 80 years. Uh there's woods there, but the shoreline is still taking all kinds of abuse from these huge
1:02:30 | waves. And an anecdotally, I'll tell you this. As I said, I lived on the lake for 50 years. I've water skied. I did a lot of competitive water skiing when I was
1:02:38 | younger. I know all about how the boats operate on the lake. And it's only since the surf they've started surf boating am
1:02:46 | I now having significant damage. I have two halfinch ropes that hold my boat together. I mean, they're big ropes and
1:02:55 | both of them have snapped from the waves coming in from these boats. I've stood right on my pier and watched the waves from their activity come in and snap my
1:03:05 | lines and actually have disrupted my pier. I have a 50ft pier, the dock that goes out with a 10-ft section at the end
1:03:12 | of it. And it's all been disrupted now because the waves come in and hit it and knock it up. Never had that problem
1:03:20 | before. So that's to show you the difference in the energy from these waves as opposed to regular boat waves
1:03:27 | which I've never had that kind of problem over the years. So So if you have a ski
1:03:35 | uh what are they called? The the water ski the uh jet ski jet ski. Yeah.
1:03:41 | closer, you not have that impact as right by and as long as they're going at
1:03:48 | a higher speed, there's no big waves. I mean, I can't say that sometimes aren't
1:03:52 | [clears throat]
1:03:53 | bigger waves from people going by slow, but never the kind of impact that these boats have. Even when they're across the
1:03:59 | lake, the waves just roll and get bigger and bigger by the time they're they come across the lake, uh because they just
1:04:05 | don't have time to dissipate. Um, part of the lake. That is a narrower part of the lake.
1:04:13 | That's the narrowest part of the lake.
1:04:18 | And you'll see the you'll see the measurements there in the middle of the lake are about 10 ft. So we had something that was a mathematic study
1:04:26 | back in 2018 that gives us a picture of it and gives us some numbers that is a
1:04:34 | little bit off from yours but again everyone has um so yeah again I go back to have that
1:04:42 | tailored to our lake and u I agree um
1:04:50 | conducted I like to be present Um, it would be actually nice to see a boat going so we could observe.
1:05:01 | I mean, you know, we we we're here to for the benefit of the lake. We're not here to keep anyone from, you know, exercise their freedom,
1:05:08 | but I think we need to get collect as much information that we we can before.
1:05:14 | Yeah, there is funding you said for here.
1:05:16 | Yes, I just got approved. Uh, I I had to wait for approval today. As we said, we have a waterways municipal
1:05:23 | municipal waterways fund uh that it clearly there's not a language there that says, you know, for studies related to surf bylaws, but there's enough
1:05:32 | language that will cover us as we're trying to um maintain the quality of water and invasive species is one of
1:05:41 | them. Shoreline is one of them. So, we'll be able to utilize those funds. I don't know the cost. uh we'll be I've
1:05:49 | requested one proposal today. There are not many uh agencies out there that provides that type of work. So I'm
1:05:56 | hoping to have some answers by the end of next week and they'll share the links and pawns committee.
1:06:02 | Is there a special wetlands designation of who can do something like that? Who can do a study like that?
1:06:09 | So I started with the company who actually are familiar with the lake.
1:06:14 | they do all the uh treatment. They already have surveys of the lake because they have to survey, but it was all
1:06:21 | related to uh invasive species treatments, right? So, uh I'm I contact
1:06:29 | them today. Unfortunately, they didn't get back to me on time for this meeting to see if they're willing or they have the capacity or they have the knowledge
1:06:37 | to conduct a different study from us knowing that they are so familiar with the lake, they already have a survey done. Would they have to do every link?
1:06:45 | It could be a possibility if it comes to that. Yes.
1:06:51 | And again, as I say, we have a we need to be fair to everyone. So, I hope the fund is big enough.
1:06:56 | Yeah. I don't know what the cost is. So, I think we could start from there. See if they are willing to do the work if they can. Uh the cost,
1:07:04 | how many lakes do we have that that should be in question?
1:07:08 | I would say it would be Glenn would be number two. I don't see any other links in town.
1:07:15 | Buff is managed by um corpus of engineer.
1:07:19 | We don't have the restriction point we all set.
1:07:30 | We made a decision.
1:07:31 | Somebody has one more uh comments if you don't mind just Stephanie. Sorry.
1:07:37 | So, can we have your name please for us young lady? Hi. Have you got an ID?
1:07:44 | Um, so I'm former secretary, vice president, president of the lake association. The Berserons
1:07:52 | consulted with me. I was not their realtor. They specifically called to ask if there was any regulations against wake surfing on the lake. I was
1:08:00 | president at the time. I called the former president and I also called the conservation office. There was no regulations against wake surfing. So
1:08:08 | they went forward with the purchase of their home. If this was something that was in the works, they would have probably chosen Webster Lake or Quinta
1:08:16 | Bigger Lake. So now we're violating their homeowner rights. Second point, when they go out wake surfing, they putt
1:08:23 | putt putt putt putt out to the deep part and then they start. When I have been on
1:08:30 | my completely docked, tied down boat, my neighbor does dock starts with his
1:08:37 | grandkids over and over again. The kids are sitting at the end of the dock and his engine will go closer to the shore
1:08:44 | and then he'll gun it right from there to pull the kids up from the dock. And I invite you to come and see the difference between the fish nests on my
1:08:52 | side and the fish nest where he is. And the other thing is when they're starting with water skiing and like you said when they're dropping off, they're swooping
1:09:01 | right in and that's another time I have to hold on. If I'm on my dock because my neighbor's going to knock me on my butt.
1:09:08 | So, and then if you've got a a beginner skier, they're starting over and over and over again to [clears throat] get that skier to stand up. So, when they're
1:09:17 | wake surfing, they're out in the middle and skiing. They're doing dock starts.
1:09:22 | The engine's right there in inches of water and there's a lot of propulsion there. So, a question for you. Does
1:09:31 | the average person know the difference between wake boarding and wake surfing?
1:09:34 | I think if you're on the lake, you do because the wake boarding, you're attached. You're holding on. The boat's pulling you and they're going faster.
1:09:42 | And like Joe said, you're also got the ballots in there creating a wave. With wake surfing, you're holding on until you get to the right spot in the wave.
1:09:52 | in the surf and then you can let go and just just like you're really stay you stay right in that little I thought we're an expert. Don't you do that?
1:10:02 | I saw do it last weekend. Thank you. You're welcome.
1:10:10 | So if the commission is uh willing to allow me to move forward with the proposals and present that to the less
1:10:18 | fun committee uh and if they do approve I'll bring back to your commission for approval of the the cost. Oh wait a
1:10:26 | minute who who approves the funds from the municipal waterway fund from me.
1:10:33 | No but who is the lake simp not our commission right? So I would not need to bring it back for approval to us tonight.
1:10:41 | So I will need a motion from the commission tonight to allow me to uh inquire proposals for the study and
1:10:48 | utilize and and send that to the link and pon committee for approval of the usage of the funds. I need a motion.
1:10:57 | I have to I have to say no. Second. Yeah, I'll second it. All in favor? All opposed?
1:11:06 | I have it. I'm sorry. Did you say no?
1:11:09 | You're not gonna You don't want us to go forward with a study? No.
1:11:12 | Okay. So, we need Sorry. Yeah. Yeah. I don't think we need it.
1:11:15 | So, they need to vote one by one if you if you're okay with the studies. Go with the study. Yep. I or no?
1:11:24 | I don't know enough about it.
1:11:26 | So, do you want do you want us to go forward spend money to get a study done on South Charlton to get us get more data on the lake and whether it's going
1:11:33 | to support wake surfing or not support wake surfing? That's what the study would do.
1:11:37 | If not, there will be no, right?
1:11:44 | So, yes or no, I guess is what I I Okay, so the motion passes.
1:11:53 | All right. So I will I'll start with the proposals and I'll bring it back when I have numbers and I'll pass along to the
1:12:00 | links and bones committee and I'll keep the commission informed for the next meeting.
1:12:04 | Now let's say the the uh peer review comes back that there isn't much detriment to self reservoir.
1:12:16 | Would we still have to abide by the state law regulation or could we allow the weight voting on that? That that's a different discussion I think because
1:12:24 | that if it came through as a state law exception.
1:12:28 | Yeah, we'd have to file for an exception or something like that. But that's that's a state exception to a state law.
1:12:34 | But I think we probably could. I mean, if we had to. Yeah.
1:12:37 | But I mean that's something we'd have to explore after that law became in effect. In effect.
1:12:42 | Anything else on the agenda that we just signing it? We can have a motion.
1:12:47 | All right. I need a motion to close the hearing.
1:12:49 | Motion to close the hearing. Thank you everybody. All in favor? Thank you for everybody coming.
