UDO Text Amendments CC35 and CC36
Context
Text amendments to the Unified Development Ordinance (UDO) heard by the City Council. UDO-CC36 is the National Flood Insurance Program compliance text amendment. UDO-CC35 amends Chapters 3 through 9. At the September 21, 2026 hearing, Chris Murphy said a last-minute change was made after the County Attorney's review of Section 5.2.44 on Land Clearing and Inert Debris (LCID) facilities: the amendment clarifies that an LCID may need a Special Use Permit from the Board of Adjustment or the Elected Body, or Planning Board review, depending on the zoning district. The City/County unified provision now reflects the County's Elected Body Special Use Permit process; Murphy said it does not change the City Council's current permitting process. Paper copies of the revised version were handed to Council Members. The General Government Committee had recommended approval on June 8, 2026 (3-0, Hall absent).
Status
Both adopted: UDO-CC36 on August 17, 2026 (8-0, no speakers) and UDO-CC35 on September 21, 2026 (8-0, no speakers).
