Core Commercial Overlay District (CCOD) Text Amendments
Context
Revised Core Commercial Overlay District (CCOD) text, Section 3.08 of the Midway Zoning Ordinance, presented by Town Manager Brock Hall after review by Town Attorney Jim Lanik. Changes: Town Council becomes decision-maker with the Planning Board advisory; 'minor alterations' defined; approval expiration cut from 2 years to 1; Council may allow small exceptions (e.g. minor facade percentage variations); screening exempt for lots next to wooded areas; brick must be hard fire kiln clay or slate (no faux brick); unclear graphics removed. Formatting may be refined during codification.
Status
Planning Board recommended approval 3/31/2026 and asked Council to call a public hearing. Town Council reviewed the draft at the February 19 Vision Session, called the public hearing April 6, held it May 4 with no speakers, and approved the changes to Section 3.08 unanimously on May 4, 2026 (McAlpine moved, Leonard seconded). A complete copy is on file with the Town Clerk. Council had also been told the apartment-height limits in the CCOD kept one apartment complex from being built in Town.
