2026-09-14 - Board of Commissioners
Summary
Monday evening meeting at which Karen Watford gave the invocation, retirees Capt. Mark Barnes and Connie Lleier were recognized, and Midway council members attended. Public address included Chuck Slabetski speaking as a candidate, data center moratorium requests of 12 months or longer, Duke Energy gas plant concerns, a Front Street Capital annexation into Lexington and accessibility. The consent agenda passed, including the data center text amendment application, opioid governance documents and coordinator position. The board approved $8.167 million for Davidson County Schools kitchen and gym HVAC work, a letter of support for Davidson Medical Ministries' federal BJA grant (called COUP in the captions; up to $1.3 million), and Doug Hunt as Board of Adjustment alternate because Christian Jones cannot serve on both boards. Two rezonings were approved after hearings: Deborah Lewis's request on Claude Felter Road (Abbotts Creek Township) to return from CZRC to RA3, and Group 21 Belmont Road Self-Storage Rezoning (7.33 acres on Belmont Road from RA1/RA2 to CZRC for self storage, by voice vote with lighting conditions) after Yates, who hauls stone for the applicant's principal, raised a recusal question; the attorney said none was needed and the board voted to let him vote. When the applicant's attorney asked for a continuance of the contentious Midway Township rezoning, the board denied it and the application was withdrawn with intent to refile (the Midway council had passed a resolution opposing it); the board then met in closed session on an outstanding legal issue.
Summary written from YouTube auto-captions of the meeting; names, figures and speaker attributions may be misheard.

0:12:29Good evening everyone.
0:12:32[clears throat]
0:12:32>> I think we have too many people for our
0:12:35room. So I think the sheriff and some of
0:12:38the deputies might ask several of you to
0:12:40if you'll just go out and we've got
0:12:42another room you can go into. And a lot
0:12:44of times these first couple of things
0:12:46that that people are not staying for,
0:12:49they'll get up and leave and then those
0:12:51people can have it have the opportunity
0:12:54to come back in. So
0:12:56>> I think there's some empty seats right
0:12:58back in there as well.
0:12:59>> Okay. Might be two or three in there.
0:13:07>> There [clears throat]
0:13:12we got everything set up.
0:13:15Yeah. Yes. The
0:13:16>> Yes, you'll be able to hear
0:13:20>> silence phone.
0:13:32>> So, you are here to speak at public
0:13:33addresses, not about one of the public
0:13:35hearings.
0:13:38>> Are you here to speak for one of the
0:13:40public hearings or a public address?
0:13:42The public hearings are the reasoning
0:13:44matters. The one for Eller Road or
0:13:46Belmont Road. Okay. Okay. You're
0:13:49perfect. Thank you.
0:13:55[clears throat]
0:14:14Ma'am, are you here to speak in one of
0:14:15the public hearings or a public address?
0:14:18>> I know. I know.
0:14:28>> Okay, ma'am. I'm going to let you go
0:14:30ahead and sign in, but I'm going to get
0:14:32started.
0:14:35Welcome to the Monday, September 14th,
0:14:392026 Davidson County Board of
0:14:41Commissioners meeting. We're glad to
0:14:43have you here with us tonight. Um I'm
0:14:46calling the meeting to order. Um I'll
0:14:49I'll take care of the invocation and the
0:14:51pledge tonight. So, if you will bow with
0:14:54me if you if you care to. Dear heavenly
0:14:57father, remind us that pride is a
0:15:00stumbling block to reconciliation.
0:15:03Help us to approach conflicts with
0:15:05humility. May we listen more than we
0:15:08speak and seek to understand before
0:15:10being understood. May we strive to view
0:15:14situations from multiple perspectives,
0:15:16finding common ground while dispelling
0:15:19animosity.
0:15:20In moments of heated exchanges, grant us
0:15:23the serenity to pause and reflect,
0:15:26choosing words with care. Let your
0:15:29spirit guide our responses so that they
0:15:31may be seasoned with grace. For in you,
0:15:34Lord, we find the strength to bridge the
0:15:37divides and illuminate the path to
0:15:40resolution and harmony. In your name we
0:15:43pray. Amen.
0:15:44>> Amen.
0:15:51I pledge allegiance to the flag of the
0:15:55United States of America and to the
0:15:58republic for which it stands. One nation
0:16:01under God, indivisible, with liberty and
0:16:05justice for all.
0:16:10>> For recognition, I would like to uh
0:16:13thank Mike McCalpine and Robin Moon.
0:16:17Councilman from Midway for being here
0:16:19tonight. Thank you for coming.
0:16:22And I'll turn it over to um Sheriff
0:16:26Simmons um to recognize Captain Mark
0:16:29Barnes and detention officer Connie
0:16:31Lleier.
0:16:40Good evening. It's that happy sad
0:16:42occasion. And I'm very happy for these
0:16:45two that have made it to the finish
0:16:47line. Very sad for us because we're
0:16:48losing two very good ones. Um Mark
0:16:52Barnes and Connie Lleier. Uh Connie
0:16:55started in 2003 and Mark in 2005.
0:16:59Um they Connie I mean she she about runs
0:17:03the jail. She's really sharp and all she
0:17:06does and uh we're going to miss her
0:17:08greatly. and Mark, he's been in about
0:17:11anything in the enforcement side of it
0:17:13as well. So, we're going to miss him.
0:17:14Um, he's captain of civil right now and
0:17:18uh and uh very happy for him. I think he
0:17:20he likes to cruise a little bit, so I
0:17:23think he's probably on the way, but love
0:17:25to give them a second to to say anything
0:17:28they'd like to.
0:17:32>> I just want to say I have been truly
0:17:33blessed. Um, I was a waitress and
0:17:39[clears throat] my shift I was working
0:17:41at Backcountry Barbecue in Lynwood. Um,
0:17:44it ended and I needed a job. And some of
0:17:47the guys from the sheriff's department
0:17:48was in there and said, uh, you know,
0:17:52they said, "What are you going to do
0:17:53now?" I said, "Well, I guess I'll go to
0:17:55the unemployment line for the first time
0:17:56in my life." They said, "Well, we've got
0:17:58an opening at the jail. Why don't you
0:18:00come tour it and, you know, see what you
0:18:03think?" Well, I felt special. I thought,
0:18:04man, they're offering me a job in the
0:18:06sheriff's office at the jail. What I
0:18:08really didn't know was there's really a
0:18:10turnover at the jail. And there's a lot
0:18:12of people come and go at the jail. But,
0:18:14you know, it must have been meant for me
0:18:16because I went in December of 03 and u
0:18:21here I am today. Amen. All these years
0:18:23later, and I've been very blessed.
0:18:25>> Um I wouldn't had it no other way. Thank
0:18:29you.
0:18:30>> Very proud, man. Amen. [applause]
0:18:39Good evening. Um, like I said, I've been
0:18:43here since
0:18:45late ' 05, early ' 06. Um, done about
0:18:49everything that you can do here. Work
0:18:51patrol. I've worked uh uh all the task
0:18:55force. I've worked uh in in learn
0:18:57affairs personnel, civil, I've worked in
0:19:00the courtrooms. Uh, I've done it all but
0:19:04the jail. [laughter]
0:19:06I've been there a lot.
0:19:08Uh, you know, and and in the school
0:19:11system, my my family works, uh, in the
0:19:13school system. Uh, wife and daughter.
0:19:16Uh, my other daughter works at the
0:19:17hospital. So, I tried to stay away from
0:19:19there because I didn't want to seem
0:19:21partial to them if I had to go there and
0:19:23deal with something because I'm going to
0:19:24I'm going to they're going to be my
0:19:27protection first and I didn't ever
0:19:28wanted that. So, I stayed away from
0:19:30there over the years. But I do
0:19:32appreciate my time. I've talked to many
0:19:35of you out of this room and into this
0:19:38room and you know we've uh we've seen
0:19:40eye to eye on a lot of things and and
0:19:42not some on others and but we've always
0:19:44had discussions about it and I all I can
0:19:46say is I appreciate it. I thank you for
0:19:48my time and letting me be here through
0:19:50these years. Thank you, man.
0:19:53[applause]
0:20:00>> Madam Chair, could I say something?
0:20:02Sure.
0:20:02>> Just to to both of y'all. I know uh uh
0:20:06Miss Lair, when when I was in the jail,
0:20:08I was a teenager and uh I started with
0:20:11Davidson County in 2000 and uh and I've
0:20:15seen both of y'all around. I've seen you
0:20:16in the garage with my dad and
0:20:18everything. And I just want to tell you,
0:20:20anybody that puts the badge on, y'all
0:20:21are heroes. Doesn't matter if you're
0:20:24working at the jail and trying to get
0:20:25people back into the community or if
0:20:27you're out working patrol or working at
0:20:29the courthouse. Y'all, [clears throat]
0:20:30y'all made a difference. And uh to be
0:20:33here today to walk away from the county
0:20:35after you've given your life to this
0:20:37county, I wish you the very best and I
0:20:40thank you for always being a
0:20:41professional and thank you for being a
0:20:43hero. God bless you.
0:20:47>> [applause]
0:20:52>> Mark, you've always been the epitome of
0:20:55professionalism,
0:20:56and I appreciate that, and I know the
0:20:58public appreciates that.
0:21:01Um,
0:21:04I I don't know what to say about you,
0:21:06Miss Lleair. You are excellent at what
0:21:10you do,
0:21:12>> and you going to have a hard time
0:21:13replacing her sheriff. I can tell you
0:21:15right now, uh, she's one of these people
0:21:18that most of you never hear or never
0:21:21see, but when you have to have contact
0:21:24with her, she is so nice and
0:21:27professional, and I've always
0:21:29appreciated that, and we're going to
0:21:31miss you.
0:21:31>> Amen. [clears throat]
0:21:33>> Thank you, Connie.
0:21:34>> Thank you.
0:21:35>> I take it what Commissioner Shale says.
0:21:37Thank you. I couldn't have done
0:21:38[clears throat] it any better.
0:21:42>> Okay. Thank you all. We'd like to take a
0:21:44picture and we'd like to
0:21:46>> shake your family back here.
0:21:48>> I know some of them are back here. Yeah.
0:21:50[laughter]
0:21:51>> Amen. Well, thank y'all for giving him
0:21:53to us for that long.
0:21:57[applause]
0:22:01>> Thank you, Mark.
0:22:05>> Dad, you didn't ask me if you could
0:22:06retire.
0:22:08>> I'm going to tell you, girl. We're going
0:22:10to miss you.
0:22:12There you go.
0:22:14>> Congratulations.
0:22:15>> Congratulations.
0:22:22>> Yes, ma'am.
0:22:29>> Okay.
0:22:38>> And one, two, three.
0:22:51Big fan.
0:22:52>> I love it.
0:22:53>> I love [laughter] it.
0:22:54>> This is why I work.
0:22:56>> Great.
0:23:02[laughter]
0:23:15Debbie,
0:23:16>> I think you need to get one with the
0:23:18sheriff and the two retirees.
0:23:28>> And then we'll bring everyone up.
0:23:38Tell me if I'm in your way.
0:23:39>> Oh, that's perfect right there. One,
0:23:42[clears throat] two, three. One, two,
0:23:44three. And one, two, three. And I'll get
0:23:48everything else up there.
0:23:55>> Amen.
0:23:57>> No. Yes. Come on.
0:24:00All of y'all that work with us
0:24:06go. There we go. [laughter]
0:24:13>> Amen.
0:24:15>> Some five people in there.
0:24:17>> Okay. We all ready? [clears throat]
0:24:19One, two, three. One, two, three. And
0:24:24one, two, three. Thank [clears throat]
0:24:26you. We'll get all these sent out
0:24:27tomorrow.
0:24:28>> Amen. Good job, y'all. [applause]
0:24:37>> Hey, man. Doing well. You
0:24:42>> Debbie, I'm sorry.
0:24:45>> About point for the sheriff. I thought
0:24:47you through.
0:24:51>> Major Louis asked me to do some flights.
0:24:53>> Yeah, I love it. Okay, Commissioner
0:24:55Shell, would you recognize our veterans
0:24:58tonight?
0:24:58>> Sure. Thank you, Madam Chair. Do we have
0:25:01any veterans in the office? If you would
0:25:03please stand,
0:25:09[applause]
0:25:15>> if you if you have not received the
0:25:17County Veterans P, if you'd come up and
0:25:20allow us to present you with one,
0:25:22please.
0:25:26Okay.
0:25:27One coming up here.
0:25:33>> Amen.
0:25:35>> Thank you for your service.
0:25:39>> Thank you, sir. Thank you for your
0:25:40service,
0:25:41>> man.
0:25:42Thank you for your service, brother.
0:25:44Give you a fish. How you doing? Good to
0:25:46see you. You look like that guy on on
0:25:48America's Got Talent. You ever seen him?
0:25:52That's such a scene like talking to my
0:25:55wife.
0:25:55>> It is really safe.
0:25:56>> Thank you, sir. Thank you. Appreciate
0:25:58it. Thank you.
0:26:03>> Okay. If you have not registered and are
0:26:06interested in speaking at public
0:26:08address, the paper is on the front
0:26:11table. We'll go on to the adoption of
0:26:13the agenda.
0:26:16Due to the anticipated length of the
0:26:18public hearings, I'm requesting that we
0:26:20be moved to follow the deliberation
0:26:23agenda. Also, Mr. Jones has asked that a
0:26:26closed session for Attorney Clump be
0:26:28added to the agenda.
0:26:30>> Oh, I'm sorry. My husband fusses at me
0:26:34about this all the time. I apologize.
0:26:36I'm going to start over. Okay. We're um
0:26:39because of the public hearing length,
0:26:41I'm requesting that they be moved to
0:26:43follow the deliberation agenda. And Mr.
0:26:45Jones has asked that a close session for
0:26:47attorney client privilege be added to
0:26:50the agenda. Are there any other changes?
0:26:53No other changes. May I have a motion
0:26:55and a second to adopt the amended
0:26:57agenda?
0:26:58>> Motion to adopt.
0:26:59>> Have a motion to adopt and a second. All
0:27:02in favor say I.
0:27:03>> I. Thank you,
0:27:07Mr. Mayus. Thank you. We do have a few
0:27:10people here for
0:27:12public address.
0:27:15Call on Jackie Taylor.
0:27:20>> Good evening everyone. I'm Jackie
0:27:22Taylor. I live in Davidson County and
0:27:24I've got great news for you guys
0:27:26tonight.
0:27:27I'm sure y'all are sick of hearing me
0:27:29talk about how I want to go back to
0:27:31senior services. And I want an apology
0:27:33from them. Well, I no longer want that.
0:27:37I want to go to a place where I feel
0:27:39safe, where I feel respected, and where
0:27:41I feel welcome. At one time when they
0:27:43were doing love bombing, I felt that at
0:27:45senior services, but in the end I did
0:27:46not. So I've also come to realize that
0:27:50I'm getting nowhere on my own through
0:27:53Davidson County locally. Therefore, I
0:27:56went to the website with um the North
0:27:59Carolina Division of Health and Human
0:28:01Services and I filed an official
0:28:04complaint about not the all the things
0:28:08that I've been talking to you about of
0:28:10the discrepancies with Tesa. This is
0:28:13solely about um the DAS
0:28:17paper registration.
0:28:20Tisha had written in that chronological
0:28:22documentation of issues Jackie Taylor an
0:28:25entry July 2019
0:28:28that I was having issues with Martha
0:28:30Cranthium. Well, this is a copy of my
0:28:34registration. My contract expired the
0:28:37end of May and so I was required to
0:28:40submit this June the 1st to renew my
0:28:43contract. Well, I didn't do that because
0:28:45when Tisha came down there to the South
0:28:47Mountain Nutrition site with Sabrina
0:28:49Orman and we talked about everything was
0:28:50going on and I told her that Martha was
0:28:53tampering with my food. I felt like she
0:28:54was going to poison me and I just wasn't
0:28:57going to renew it. And so I sent her an
0:28:59email and I told her that I forwarded
0:29:02that to Commissioner Matt Miselle and
0:29:05you know all of y'all know that. And so
0:29:08[clears throat] the point of all this is
0:29:10I did not renew the contract in June. So
0:29:13therefore, I was not there in July. And
0:29:16they've had almost six years to admit,
0:29:19no, you weren't there and apologize to
0:29:21me for the mistake. But they would not
0:29:23do that. And also on this form, it's got
0:29:25a place here other. You know, you're
0:29:27supposed to list when you become in
0:29:29inactive or, you know, not there or
0:29:31whatever. They give you choices, but
0:29:33other and they should have put down that
0:29:36I claimed that I was afraid that I was
0:29:38gonna they were tampering with my food.
0:29:41So, you don't put down anything else
0:29:43other than what I said and I wrote. I'm
0:29:46not renewing it because I'm afraid to
0:29:48eat the food. Well, they all they have
0:29:51to do is produce the paper and then we
0:29:53know. Well, they wouldn't do that. So,
0:29:56because they wouldn't do that, I filed
0:29:58the official complaint. They sent me a
0:30:00confirmation to my email, submitted on
0:30:02Sunday, September 13, 2026 at 10:04 in
0:30:06the morning. I will be giving these
0:30:08papers to our clerk to put in the the
0:30:11minutes for to be, you know, preserved
0:30:13forever
0:30:15and when they start the um audit
0:30:20might take some time. So, it's probably
0:30:22going to end up when you have your new
0:30:24commissioners. Ma'am,
0:30:26>> anyway, I don't have time to finish
0:30:27this. So I am giving this paper to the
0:30:31DASS,
0:30:33my nutrition program thing for May to
0:30:35show what I was doing,
0:30:37my handwritten notes showing how
0:30:40dissatisfied I was, what I wrote to the
0:30:42editor wrong on
0:30:45many levels, and where I didn't like our
0:30:48um volunteer coordinator putting Donald
0:30:51Trump's face as a funeral and spring
0:30:55ruled in my favor with These are given
0:30:58to Debbie to go into the permanent file.
0:31:00Thank you.
0:31:02>> Thank you.
0:31:05>> All right. Tyler Tyrie.
0:31:10>> Good evening, everyone.
0:31:13[clears throat] My name is Tyler Tyrie.
0:31:15I have originally planned to come up
0:31:17here and be in support of moving forward
0:31:19with the regulations rather than a
0:31:21moratorum on the data centers in this
0:31:23county. However, over the past few days,
0:31:26I have found many examples of other
0:31:28counties in North Carolina enacting
0:31:29these moratoriums and even completely
0:31:32pushing out large data centers from
0:31:34their county. For example, Edgecom
0:31:36County, North Carolina. In July 2026,
0:31:39the developer Energy Storage Solutions
0:31:42officially withdrew its proposal to
0:31:44build a massive 19.2 billion artificial
0:31:47intelligence data center campus at
0:31:50Kingsboro mega site near Tarbor.
0:31:53>> [clears throat]
0:31:54>> The cancellation happened directly
0:31:56because of intense intense public push
0:31:58back. Local residents packed meetings,
0:32:00gathered over,300 petition signatures
0:32:04raising flags about immense water
0:32:05consumption,
0:32:07massive electricity demands, and up to
0:32:09900 megawws, backup generator noise, and
0:32:12hikes in local utility bills. In
0:32:14response, the citizen to citizen
0:32:16pressure, county commissioners began
0:32:18aggressively pursuing a 24-month
0:32:20mortorium. Is that what Davidson County
0:32:23needs to do? I am more than willing to
0:32:25start a petition if that's what it takes
0:32:27to show you guys how serious this is.
0:32:31[clears throat] A six-month mortorium is
0:32:32nothing. Personally, I think that our
0:32:34county needs a 12-month mortorium for
0:32:36data centers. Thank you for your time.

0:32:46Tim Bumgardner
0:32:59Hello everybody. [clears throat] Hello.
0:33:01Uh I'm going to go off topic for just a
0:33:04minute. I don't I don't want to speak on
0:33:05the AI yet or the data centers yet
0:33:08because I'm actually uh I think a short
0:33:11term is a good thing, but uh I'm leaning
0:33:14towards bringing them on in and I'm very
0:33:16careful about anything that my county
0:33:17spends money on or at least I watch it.
0:33:20But I want to go back to the mines that
0:33:22I've discussed two times up here before.
0:33:25The the one over here at Silver Hill and
0:33:26the bird mine over here right on the
0:33:28edge of uh Randolph County.
0:33:31I handed everybody up here that was up
0:33:33here before
0:33:35six pages proving that those reserves
0:33:38were on that land
0:33:41and I was told once by you that they did
0:33:44not exist that no that you did a survey
0:33:47and they did not exist. I showed you the
0:33:49survey. I proved it and I hope that
0:33:51everybody in here that wants to learn
0:33:53wants the county to start producing
0:33:55revenue.
0:33:58If you want proof as to as to whether
0:34:00though there has been proven reserves
0:34:02out there, I I invite you to go to metal
0:34:05source
0:34:07and gold gold stake minerals
0:34:10metalsourcemining.com
0:34:12out of Canada and gold source gold
0:34:15strike
0:34:17minerals out of North Carolina. [snorts]
0:34:20Both of those have their website.
0:34:21They've got the proof on there that
0:34:23they've got proof so that we we settled
0:34:25for somebody on this board settled for
0:34:27$200,000 in paving materials. That's
0:34:300.00005%
0:34:33of the three billion reserves out there.
0:34:35And it's proven out there. I looked at
0:34:37it before I walked left home. Their
0:34:39stocks already rose 300% in one year
0:34:41since I brought this up. Why isn't the
0:34:43county
0:34:45getting something out of this?
0:34:47Alaska demands 5% for any oil is taken
0:34:50out of the ground. There are ways to get
0:34:52revenue off of these $3 billion of
0:34:54mines, not $200,000 peddly dollars.
0:34:57That's nothing. That's not even a piece
0:34:59of land down here at the at the lake.
0:35:03Something's going on. We can invest that
0:35:05in so many ways. The stocks already
0:35:07tripled. And I believe some of you
0:35:09probably already know that. In fact, I'm
0:35:10certain of it. I have all of that
0:35:13documents to prove this. I don't I don't
0:35:14need to debate it back and forth. The
0:35:16reserves are out there. We need to start
0:35:18looking into it and figure out how this
0:35:19county can make some money
0:35:22legitimately lawful. I don't like being
0:35:25shut down by your attorney when I go up
0:35:27here to the register deed to do my
0:35:28research. Public information is public
0:35:31information.
0:35:33I think we ought to all start looking
0:35:34into that. The AI, look, I'm good with
0:35:36that. I believe it's going to bring in
0:35:37some serious revenue, but only when the
0:35:39county starts doing things right. You
0:35:41don't take it off the homeowners. You
0:35:44produce the revenue. It's your fudiciary
0:35:46of responsibility.
0:35:48Number one, that's your oath.
0:35:51Do what's best for the county.
0:35:55[applause]
0:35:57Madam Madam Chair, I got a question for
0:35:59the board. Um, it was my recollection
0:36:03that the owner of this property came and
0:36:06told us out of his own mouth that he
0:36:08wished that this this would have been
0:36:10full of silver and gold. He's he's went
0:36:13through, he's dug, he's tried, he's had
0:36:15surveys. They dug uh 300 400 holes. They
0:36:18couldn't find any ore at all. And uh he
0:36:22said that's why he decided to start
0:36:23building houses on this area and uh to
0:36:27regulate it or to try to do something
0:36:29else with it. But it is that correct? Am
0:36:33I Am I thinking about something? Okay.
0:36:35He didn't
0:36:36>> because we heard it straight from the
0:36:37horse's mouth. Straight from the owner
0:36:39that owns the property that he wished he
0:36:41could be a billionaire that it had all
0:36:43this on here,
0:36:45>> but it's not. No, it's privately
0:36:46privately owned property and we would be
0:36:49more like a socialist country to steal
0:36:51that from somebody who owned it even if
0:36:54there was silver or gold on it. But I I
0:36:57just I thought that's what he told us.
0:37:01>> Okay. Thank you. I want to make sure I
0:37:04heard that correctly.
0:37:05>> Janine Purdo.
0:37:22Hello.
0:37:24Tonight I want to speak plainly about
0:37:26what is at stake for Davidson County.
0:37:28Duke Energy says massive new gas
0:37:31infrastructure is needed because
0:37:33electricity demand is growing. But let's
0:37:36talk about what is driving the growth.
0:37:38Duke has said data centers represent
0:37:40more than 85% of the projected load
0:37:43growth from new economic development
0:37:45projects seeking electrical service.
0:37:4885%.
0:37:50And communities like ours are being
0:37:51asked to bear the consequences.
0:37:54industrial development, air pollution,
0:37:56pipeline expansion, loss of farmland,
0:37:58threats to water, and increased demands
0:38:01on firefighters and emergency services.
0:38:05Now, there is another reason for
0:38:06urgency. The Trump administration is
0:38:08moving to roll back federal pollution
0:38:10protections affecting fossil fuel power
0:38:13plants. Regardless of your politics, ask
0:38:17yourself, does weakening pollution
0:38:19protections make Davidson County safer?
0:38:22Of course it doesn't. Building massive
0:38:24new fossil fuel infrastructure while
0:38:26weakening the safeguards meant to
0:38:28protect the public isn't common sense.
0:38:30It's reckless. And commissioners, that
0:38:33makes your responsibility greater than
0:38:35ever. We've been told state and federal
0:38:38agencies will protect us. But what if
0:38:40Washington weakens those protections?
0:38:43Who protects Davidson County? You do. If
0:38:47Washington lowers the bar, Davidson
0:38:49County must raise it. demand independent
0:38:51air and water monitoring, comprehensive
0:38:54environmental studies, emergency
0:38:56response plans, and use every lawful
0:38:59zoning and land use authority available
0:39:01to protect the county. Because Duke
0:39:03Energy, well, they'll protect Duke
0:39:05Energy. Data Center developers will
0:39:08protect their own interests. Your job is
0:39:10to protect ours. You weren't elected to
0:39:13protect corporations that may arrive
0:39:15tomorrow. You were elected to protect
0:39:18the people who are already here. And
0:39:20it's bigger than one gas plant or data
0:39:22center. It's about what Davidson County
0:39:24will become. [clears throat] We will pro
0:39:26will we protect our farms, our forests,
0:39:29our rural communities, and our
0:39:30waterways. Or will Davidson County
0:39:33become the utility corridor powering
0:39:35someone else's industrial expansion?
0:39:38Once farmland is industrialized, we
0:39:41don't get it back. And if we damage the
0:39:43Yadkin River, our drinking water source,
0:39:47there is no acceptable apology for that.
0:39:50Commissioners, years from now, people
0:39:52will look back at this decision being
0:39:54made right now. They will either say,
0:39:56"They saw what was coming and they
0:39:58protected us." Or will they ask, "Why
0:40:01didn't they stop it when they had the
0:40:02chance?" You have the chance now. Duke
0:40:06will protect Duke. The data centers will
0:40:08protect themselves. We need you to
0:40:10protect us. our air, our water, and the
0:40:13Yakan River, and send one unmistakable
0:40:16message. Davidson County is our home,
0:40:19and it will not become the sacrifice
0:40:21zone for America's data center boom.
0:40:25[applause]
0:40:32Gary or or excuse me, Oroli
0:40:39>> [clears throat]
0:40:44>> I'm here to pick up my $5,000 check
0:40:46today.
0:40:48Anyway,
0:40:49I'm tired. I come here tonight
0:40:52exhausted. I'm tired of talking to a
0:40:54group of individuals who put themselves
0:40:57before they put the people of this
0:40:58county. I'm tired of doing homework. I'm
0:41:01tired of going to visit water treatment
0:41:03plants. I'm tired of going to board of
0:41:05election meetings. I'm tired of going to
0:41:07Duke energy meetings. I'm tired.
0:41:11Knowledge is power. You people have the
0:41:14power, but very little knowledge. That's
0:41:17the problem. You are in the process of
0:41:19building a sports complex that nobody
0:41:22wants. You sign NDAs behind the backs of
0:41:25the public. It's shady and it smells
0:41:28bad. You don't believe in climate
0:41:31change. Imagine that. You all think that
0:41:34data centers are going to be the solve
0:41:36to they're going to come and solve all
0:41:38of our problems and issues. That's
0:41:40shortsighted.
0:41:42A data center is obsolete in four years
0:41:44tops. If you don't know why, ask me
0:41:47later and I'll be happy to explain it to
0:41:49you. Enough about my issues with this
0:41:52board. Even though we do have two
0:41:54responsible candidates up on this board
0:41:57here tonight, I would like to focus on
0:41:59your replacements in the upcoming
0:42:02election. If you want clean drinking
0:42:04water, air you can breathe, responsible
0:42:08leadership, a man you can trust, a man
0:42:11without a personal agenda to enrich
0:42:13himself, a person who is smart, a good
0:42:17listener, and a Marine veteran. That man
0:42:21is my friend Chuck
0:42:23Scalp Slipketsky. I knew I was going to
0:42:27[ __ ] it up. Chuck, he called out He
0:42:30calls out injustice when he sees it. He
0:42:32stands up for the people and he is more
0:42:34willing to fight back against corporate
0:42:36interests. He believes in climate change
0:42:39because he believes in science. Chuck
0:42:41was a teacher of electronics. Chuck is a
0:42:44mechanic. Chuck is a leader. Chuck is
0:42:46our best hope for a clean yet prosperous
0:42:49future. Chuck will not leave anyone
0:42:51behind. Chuck will grow our economy
0:42:54without destroying our natural resources
0:42:56and farmland.
0:42:58Chuck will listen to the public opinion.
0:43:01After all, Chuck understands that he
0:43:03will work for us and not against us. If
0:43:07you are tired of being disrespected by
0:43:09the elected officials, it's time to vote
0:43:12for Chuck. If you are tired of the lies
0:43:15from your elected officials, it's time
0:43:18for the truth. It's time for Chuck. If
0:43:22you want to know your future health and
0:43:24environment will be protected, it's time
0:43:27for Chuck. Do you know what? Do you want
0:43:31to know why it's time for Chuck? Because
0:43:34unlike people, Unlike you people, Chuck
0:43:38gives a [ __ ] Vote, vote, vote, vote for
0:43:42Chuck. Thank you. Have a good night.
0:43:45[applause]
0:43:55>> Jessica Bruff.
0:44:02Good evening. My name is Jessica Bruff.
0:44:05I'm standing before you today with
0:44:07concerns that we have been dealing with
0:44:08for quite some time. And that concern is
0:44:10transparency. For the past several
0:44:13months, I've done nothing but fight for
0:44:14my peace and tranquility. Unfortunately,
0:44:16it has not been very peaceful. In
0:44:19February 2025, a podcast aired with
0:44:21Mayor Hayes, Todd Yates, and Johnny
0:44:23Taylor. The topic was the EDC. And
0:44:25during that discussion, Todd and Mayor
0:44:27Hayes talked about transparency.
0:44:29Then in May of 2026, the county
0:44:31commissioners had a meeting concerning
0:44:33NDAs, EDC, and once again, transparency.
0:44:37Maybe we have a different idea of what
0:44:39transparency actually means. In May of
0:44:422026, Front Street Capital petitioned to
0:44:45be annexed into the city of Lexington.
0:44:47Because of this area's contagious with
0:44:50the surrounding city limits, only a
0:44:5210-day notice needed to be given to the
0:44:54county commissioners. But during those
0:44:5610 days, nothing was communicated to us,
0:44:58your citizens. I found out through a
0:45:01Facebook video, and even that video gave
0:45:03us very little information to go on. I
0:45:06was heartbroken and I was scared about
0:45:08what this could mean for our not so
0:45:10distant future. We had no one to help
0:45:13guide us. We had no explaining on what
0:45:15was to happen or what this could mean
0:45:17for our community. And I truly believe
0:45:20that if that Facebook video had never
0:45:21been posted, this may have gone under
0:45:24the radar as well. Now that the city
0:45:26limits are moving further down Highway 8
0:45:28and Lynwood Southmont Road, I have to
0:45:30ask, who's to say that when other land
0:45:33owners decide to sell their land, they
0:45:35cannot petition to be annexed into the
0:45:37city? Remember, it's not necessarily
0:45:39homes and the people. It's the land. And
0:45:42if that land continues to be annexed,
0:45:44little by little, our community can
0:45:46change. We cannot run for city council.
0:45:48We cannot even join the Lexington
0:45:51Academy because we are county citizens.
0:45:54So when the decisions are being made
0:45:56that can affect our homes, our families,
0:45:58our community, and our future, we
0:46:00deserve to know what is happening. We
0:46:02deserve to be informed. We deserve to
0:46:05have a voice and we deserve
0:46:06transparency. So speaking of
0:46:08transparency, I have a few questions I
0:46:10would like answered. Can you enlighten
0:46:12us about Project Tom Machine or Rugula
0:46:16Sunday and Atlantis B? What are these
0:46:18projects? Where will they be located in
0:46:21our county? Now, I'm not standing here
0:46:23tonight because I want to create
0:46:24conflict. I'm standing here because I
0:46:26care about my community and I care about
0:46:28what's happening to our future. All I'm
0:46:31asking is for communication, honesty,
0:46:33and transparency. We should not have to
0:46:35find out about major changes to our
0:46:38community through Facebook. We should
0:46:40not have to wonder what is happening
0:46:41around us. We deserve answers. And thank
0:46:45you for listening.
0:46:48[applause]
0:46:57Pam
0:47:00McAfey.
0:47:14>> Hello.
0:47:17Um, I'm here today as president of Revup
0:47:21NC, which stands for register, educate,
0:47:23vote, use your power North Carolina. And
0:47:26I appreciate the opportunity to speak
0:47:28before our representatives today. We,
0:47:30persons with disabilities, are the
0:47:33largest, most diverse, marginalized
0:47:35community in
0:47:37in our country, in our county. Yet, we
0:47:41continue to remain an afterthought. I
0:47:43also serve on the Davidson County
0:47:45Transportation Advisory Board and I want
0:47:48to say I'm so proud of our
0:47:49transportation system here in Davidson
0:47:52County. But I and I love it. It's very
0:47:55accessible to get on and off when you
0:47:56have a wheelchair mobility devices, but
0:47:59I'm extremely disappointed in the fact
0:48:02that the bus stops are very
0:48:04inaccessible. If you can get to a bus
0:48:06stop, great. But getting to the bus stop
0:48:09when you have a mo mobility device here
0:48:11in Thomasville or in Lexington is
0:48:13ridiculous. A lot of people have to go
0:48:15in the roads. There's no place for us.
0:48:18So I also serve on the human relations
0:48:20board and recently participated in a
0:48:22walk audit in neighborhoods in Lexington
0:48:25and seeing the disrepair. I mean I know
0:48:27that's Lexington and not the county but
0:48:30still we remain an afterthought. So my
0:48:33question is,
0:48:35oh, I've also visited some uh public
0:48:37housing.
0:48:39It's deplorable. It's falling down
0:48:41around the people who have to stay there
0:48:43and a lot of times that's the only place
0:48:44that they can't afford to stay. A lot of
0:48:46prisons with disabilities, a lot of
0:48:48seniors, that's their only option. I'm
0:48:50lucky enough to have a nice house. I'm
0:48:53lucky enough that I have a nice
0:48:55wheelchair.
0:48:56>> [gasps]
0:48:57>> My question to you is with all the
0:49:00things that are going on here in
0:49:01Davidson County that need our attention
0:49:03like our schools, like the bus stops,
0:49:06why are we investing in a sports plex?
0:49:08Why are we investing in a data center?
0:49:11you know, regardless of the the public
0:49:13outcry, regardless regardless of how
0:49:15people are concerned about these, we're
0:49:18putting band-aids on all the problems
0:49:21here and investing in things without
0:49:23listening to the people who you work
0:49:26for.
0:49:28I don't think any of my concerns are
0:49:30going to be addressed anytime soon, but
0:49:32an accessible place for me to attend
0:49:34this meeting or anyone with mobility
0:49:37device. I would love for that to be done
0:49:39at least by next time I show up here.
0:49:41That should be addressed because it's
0:49:43the ADA. It's federal law.
0:49:45In conclusion, please make sure that the
0:49:47people with disabilities in your life
0:49:49are able to vote and have a voting plan.
0:49:52Like I said, it is disability awareness,
0:49:54disability voting rights week, and our
0:49:57vote is the one thing that we all hold.
0:50:01You work for us, and I take my job as a
0:50:03voter seriously, and [snorts] it's time
0:50:05you take your job as our representative
0:50:08as seriously.
0:50:12Thank you, [applause]
0:50:20>> Kimberly Title Bomb.
0:50:35>> Can I be Am I heard?
0:50:37>> Yes, ma'am.
0:50:38>> Excellent. Uh, I'm Kimberly Tatbomb. I
0:50:41live in uh Thomasville. Do you all need
0:50:43my address or not?
0:50:45>> Nope. Okay. Um, I'm here to talk about,
0:50:49believe it or not, big surprise, data
0:50:51centers. Um,
0:50:54I think my questions are sort of
0:50:58ordinary and it's just simply why should
0:51:00we allow them here here in Davidson
0:51:03County? I mean, let's face it, if it
0:51:06happens, we're the ones that are going
0:51:08to have to deal with the noise
0:51:10pollution. The owners won't, will they?
0:51:13We're the ones who are going to possibly
0:51:15see our property taxes go up, but our
0:51:18property value go down. We're going to
0:51:21we're the ones who are going to see the
0:51:23destruction of farmland when once it's
0:51:25destroyed, we can't get it back. And
0:51:28same thing with wildlife habitats.
0:51:31Uh the owners won't have to deal with
0:51:33that. They live far, far away.
0:51:36We'll have our waterways imperiled, not
0:51:39the owners. Our electric bills are
0:51:42likely to increase to pay for the power
0:51:44plants and the transmission lines that
0:51:46these data centers are going to need.
0:51:50But are we going to reap the profits?
0:51:52No. That that goes to the owners. Um, we
0:51:57are asked to show her all of the
0:51:59burdens, but we're not going to get any
0:52:01of the benefits.
0:52:03You know, I'm reminded of what happened
0:52:06in Kentucky coal country. My first my
0:52:08late husband was from Edmonton County,
0:52:11Kentucky.
0:52:13And when the coal mines came in
0:52:15promising that they were going to strip
0:52:18mine, but they promised parks and they
0:52:20promised schools and they said that they
0:52:22were going to give good jobs to people.
0:52:25And when the when the coal was gone,
0:52:27that they were going to put it all back
0:52:28the way it was, the way God created it.
0:52:31And you know what happened? There was no
0:52:34parks. There were no schools funded by
0:52:36the coal companies. Yep. The coal miners
0:52:39got pretty good jobs for a while until
0:52:42the black lung got them.
0:52:45And then when all the coal was gone, you
0:52:48know what happened with the coal
0:52:49companies? They declared bankruptcy and
0:52:53they shut their doors. And then they
0:52:55opened them the very next week, the very
0:52:57same companies, but under new
0:52:59reorganization.
0:53:01And then the court said that they
0:53:02weren't going to be liable for what the
0:53:05previous company had promised. So if you
0:53:08want to see what big companies can do to
0:53:11a small rural community when all they
0:53:14want is profit,
0:53:16go to Edmonton County, Kentucky.
0:53:20We don't want that happening here. We
0:53:22have a beautiful county. We have good
0:53:23people here. And they most of us are
0:53:26here because we chose to be here. So
0:53:30with that in mind, I think we need to
0:53:33put the brakes on any development of
0:53:36data centers until we've had at least a
0:53:39year to study to talk to places to talk
0:53:43to people who've already have have had
0:53:45them and are dealing with problems with
0:53:47water pressure, with the so-called
0:53:50closed loop water systems, which are
0:53:52nothing of the kind, with all the
0:53:54problems that go along with it. We owe
0:53:57it to ourselves. We owe it for our
0:54:00children and to this beautiful county.
0:54:03Thank you for listening to me. But for
0:54:05God's sakes, let's slow down till we can
0:54:07get some regulation and guard rails up.
0:54:10[applause]
0:54:21All right, we're move on to item number
0:54:24eight, the consent agenda. Are there any
0:54:26items to remove from the cons? I'm on
0:54:29the list to talk.
0:54:33>> Chuck,
0:54:34>> come on up, Chuck.
0:54:35>> Come on up. I don't I don't
0:54:37>> Yeah, there.
0:54:38>> I just skip. I apologize.
0:54:40Apologize. Come on up.
0:54:43>> Well,
0:54:44I've been here a number of times before
0:54:47>> and I really would like to say something
0:54:50good about this board and there's
0:54:53actually two things I can say. Number
0:54:56one, I really appreciate the time when
0:55:00uh you guys asked for uh more time
0:55:04dealing with the um um the trans park
0:55:08and the uh environment. I appreciate
0:55:10that. And the second thing you you uh
0:55:14this board did was when you brought down
0:55:17the the flock cameras, you voted for
0:55:19that. Those are the only two things I
0:55:22can appreciate and thank you for, and I
0:55:25honestly do. Now, what in the world were
0:55:29you doing with the flock cameras anyway?
0:55:32Number one, all of us didn't want it and
0:55:35put so much pressure on you that you had
0:55:37to pull them down. Meanwhile, you wasted
0:55:40a lot of money. According to one source,
0:55:44$85,000.
0:55:46I don't know if that's accurate, but I
0:55:48know you spent some money. Money that
0:55:50could have been used elsewhere on so
0:55:53many other projects. I've been asking
0:55:56for month after month after month, where
0:55:59are you driving this bus? What do you
0:56:02see as the future of Davidson County?
0:56:05Cuz my wife and I moved here recently,
0:56:08about 3 years ago, because we fell in
0:56:10love with the place. and you're
0:56:12destroying it by I don't know what
0:56:16either incompetence or corruption
0:56:18because I can't come up with any other
0:56:20terms that would explain what you're
0:56:23doing. Nothing seems to make any rhythm
0:56:26or rhyme. Nothing seems to get into your
0:56:30heads what we want as a county. Now, one
0:56:35individual on this board, and I
0:56:37certainly appreciate his efforts, sent
0:56:39me some information as to what the
0:56:42county proposed they wanted to do for
0:56:45the future. Exactly what I was asking.
0:56:48Now, this was from 2009.
0:56:53And in that, the people then wanted
0:56:56clean air. They wanted clean water. They
0:56:59wanted to help the farmers. That's
0:57:02exactly what we want. Now, it didn't say
0:57:06anything about trans parks. It didn't
0:57:09say anything about um data centers. It
0:57:12didn't say anything about uh Duke
0:57:15Energy. It did say that it wanted some
0:57:18um and it was kind of unclear, but it
0:57:21wanted some tech jobs. It did say that
0:57:25it wanted some automotive uh industry
0:57:28here, which I assume was probably
0:57:30Toyota, which that thing fell through
0:57:33from my understanding. This before I was
0:57:35here. But in any case, everyone is mad
0:57:40at you and they're mad at you because
0:57:43there's no transparency. There's no
0:57:46plan. You don't seem to have anything uh
0:57:51planned. You don't seem to have anything
0:57:53planned for the future and you don't
0:57:56seem to listen to what the people want.
0:57:59Hence, you don't represent us. And
0:58:02that's why I'm running. I'm running for
0:58:05one of your seats. And I don't want to
0:58:08run, but I don't trust any of you. Thank
0:58:12you.
0:58:13[applause]
0:58:23I didn't skip anybody else, did I?
0:58:25>> Yeah. Sorry about his name.
0:58:27>> I apologize.
0:58:30>> I didn't mean to do that.
0:58:33>> All right. Now, we're going to the
0:58:35consent agenda. Um, are there any items
0:58:38to remove?
0:58:40>> Seeing none, Madam Chair, I make
0:58:42[clears throat] a motion that we approve
0:58:43the consent agenda is read.
0:58:45>> Thank you, sir. Do I have a second?
0:58:47>> A second.
0:58:48>> A second. All in favor say I.
0:58:51>> I.
0:58:52>> Thank you very much.
0:58:56>> Okay. Item number nine, items for the
0:58:59decision information deliberation.
0:59:03First of all, um, Mr. Mayus and Dr.
0:59:06Slate will lead this off. Approval of
0:59:09Davidson County School's capital funding
0:59:11request.
0:59:14Mr. Dr. Slate here. Here he is.
0:59:16>> Yes, Dr. Slate's [laughter] here. Um,
0:59:19I'll get started. We have Dr. Slate and
0:59:21Mr. Chris Johnson here that can explain
0:59:23this uh request a little further, but
0:59:25you all are, you know, fully aware of
0:59:28the
0:59:31you all are fully aware of the capital
0:59:32improvement plan we have and they
0:59:34they've had um um over the next five
0:59:38years 12, you know, $8 million give or
0:59:42take available or or upcoming. Right
0:59:45now, we have $8.1 million available for
0:59:47them that they plan on doing some major
0:59:49capital renovations as far as HVACs are
0:59:51concerned. And today, they're just here
0:59:54to make that formal request. And I have
0:59:57a budget amendment queued up and I'll
0:59:58let them explain their plans.
1:00:02>> Good evening, Madam Chair, Mr. Vice
1:00:04Chair, Commissioners. Thank you for your
1:00:06time today and for your continued
1:00:07partnership and support of Davidson
1:00:09County Schools. Your commitment to our
1:00:11capital projects, particularly the
1:00:13critical HVAC updates to our kitchens
1:00:16and gymnasiums, is making a direct
1:00:19positive impact on the daily environment
1:00:22for our students and staff. To give you
1:00:24a clear picture of how your investment
1:00:26is being deployed, I'd like to share an
1:00:28update on the progress of the expenses
1:00:30thus far. Um, in our storage and kitchen
1:00:34areas uh since the spring, Davis County
1:00:37Schools has worked with contractors on
1:00:39split systems that have been
1:00:41successfully installed and are
1:00:43operational across five schools. Those
1:00:46being South Davidson, Brown Middle,
1:00:48Northwest Elementary, Southwood
1:00:50Elementary, and East Davidson High
1:00:52School. The total cost of these projects
1:00:54is $273,700.
1:00:58These projects are now nearly ready for
1:01:00bidding. The installation of outdoor
1:01:02large equipment for duck work uh to
1:01:06support larger changes to the kitchens
1:01:08due to the fact that they have
1:01:09significantly large hoods that pull a
1:01:12lot of air out. and our major kitchen
1:01:15HVAC projects. We have four major
1:01:17kitchen projects underway totaling
1:01:201,788,726
1:01:24at North Davidson Middle School. The
1:01:26kitchen now has a split system and duck
1:01:28work has been installed. A concrete pad
1:01:32has been poured and the outdoor unit has
1:01:34been delivered. The cost for this major
1:01:37project is $377,653.
1:01:41at Central Davidson High School. A split
1:01:44system, duck work, a new outdoor unit,
1:01:46and both supply and return return duck
1:01:50work are fully installed at a cost of
1:01:52$468,600.
1:01:55At Leadford High School, a split system,
1:01:59duck work, new lighting, and outdoor
1:02:01units with the supply and return return
1:02:03duck work are installed at a cost of
1:02:06$444,520.
1:02:09Lastly, at West Davidson High School, a
1:02:12split system and duct work are
1:02:13installed. A concrete pad has been
1:02:15poured, and the outdoor unit arrived
1:02:18today. Um, all for a cost of $497,953.
1:02:24Shifting to some updates regarding our
1:02:26gyms. Work is commenced on the North
1:02:28Davidson High School gym project with
1:02:30Matthews Mechanical starting replacement
1:02:33efforts designed to proceed without
1:02:35impacting school operations. The cost of
1:02:38this project is $1,631,900.
1:02:42As noted, we have spent a grand total of
1:02:44$3 million 694,326
1:02:49on these projects, which the county
1:02:51graciously has funded 3.5 so far.
1:02:54Tonight, we are seeking the additional
1:02:564.667
1:02:58million uh to continue the work on the
1:03:00next phase of kitchens and gyms. Despite
1:03:03recent administrative changes elsewhere,
1:03:05Davidson County Schools remain steadfast
1:03:07in sticking to the plan established in
1:03:09August of 2025.
1:03:11DCS is fully committed to staying the
1:03:13course, seeing these projects through to
1:03:15completion, and responsibly utilizing
1:03:18our tier 1, 2, and three capital budget
1:03:20allocations that you give us to maintain
1:03:23and repair existing HVAC infrastructure
1:03:26as well as other major operational and
1:03:28maintenance task. Once we have completed
1:03:31all of the major projects in this fiscal
1:03:33year and into the coming fiscal years,
1:03:36we are excited about how this will help
1:03:38our students and staff. We understand
1:03:40that looking ahead, our ultimate goal
1:03:42will have to transition.
1:03:45Davis County Schools is looking at ways
1:03:47to move from reactive repairs to a
1:03:50proactive preventative maintenance model
1:03:52for all HVAC systems. However, achieving
1:03:55true preventive maintenance requires
1:03:57additional personnel and adequate
1:03:59personnel. Currently, we lack the
1:04:02manpower necessary to sustain that level
1:04:05of ongoing care. And down the road, we
1:04:08will continue to need your support to
1:04:10make this goal a reality.
1:04:12We firmly believe that over the next
1:04:14several years, the strong collaboration
1:04:16between county government and Davis
1:04:19County Schools will help support the
1:04:20physical plan of our facilities and
1:04:23continue to create learning environments
1:04:24in our schools that foster excellence in
1:04:27student achievement. Thank you once
1:04:29again for your unwavering commitment to
1:04:32our schools and to the well-being of our
1:04:34students and staff.
1:04:37>> Any questions?
1:04:39Any questions
1:04:41>> from anybody?
1:04:42>> Okay. Thank you very much.
1:04:44>> Thank y'all.
1:04:44>> Yeah. Thank you.
1:04:48>> So,
1:04:50what's your position on?
1:04:52>> Oh, it's in the plan. It's I just need
1:04:55needs a budget amendment to approve the
1:04:57the appropriation and we have the the
1:04:59project set up. The the budget
1:05:00amendments laid out here in the agenda
1:05:02item.
1:05:03>> So, we're appropriating a 4 million or
1:05:05the whole
1:05:06>> appropriating 8.167. So the three and a
1:05:08half million that he referenced was in
1:05:10the in the capital plan last year. We
1:05:12didn't quite get it appropriated into a
1:05:14project yet. So that's that's going to
1:05:16get appropriated as well with another
1:05:184.667. So the total I ask is
1:05:20>> okay
1:05:21>> 8.167 million which is in in the CIP.
1:05:25>> Okay.
1:05:26>> I make a motion that we approve the
1:05:278.167 million for the needed repairs at
1:05:31the school facilities. And I'd like to
1:05:33also offer I know you've went out there
1:05:36multiple times yourself and fixed
1:05:38problems. I thank you for that for our
1:05:40kids. Thank you.
1:05:41>> So we have a motion. Do I have a second?
1:05:43>> Second.
1:05:44>> I have a second. All in favor say I.
1:05:46>> I.
1:05:48>> Thank you, Dr. SL.
1:05:49>> Thank you for your report.
1:05:52[applause]
1:05:56>> Okay. Miss Hurley, I'll call on her.
1:05:58Davidson Medical Ministries permission
1:06:00to apply for COSUP grant with support
1:06:03letter Sharon is also here with our
1:06:07grant to the sheriff's department.
1:06:09>> Okay.
1:06:13>> Good evening. We're here to ask tonight
1:06:16to apply for a COUP grant and um Sharon
1:06:19Pope has graciously um accepted to help
1:06:23us apply for that grant and so I'd like
1:06:24her to share that information.
1:06:26>> Okay. Good evening. Um the COUP grant uh
1:06:29some of you may be wondering uh again
1:06:31what COP stands for. This is a
1:06:33comprehensive opioid stimul stimulant
1:06:36substance use program. This is a federal
1:06:38grant through the Bureau of Justice
1:06:40Assistance. You may recall u back in the
1:06:42spring we came before you and this board
1:06:45approved uh another grant that is still
1:06:48under deliberations. is called the
1:06:50bridge project with substance misuse uh
1:06:54whether that be opioids, stimulants, any
1:06:57uh drugs within our community. Uh those
1:07:00problems are on a continuum. Uh at any
1:07:03point in that continuum, there is uh
1:07:06issues that result for our communities.
1:07:08This the original bridge project
1:07:11addressed what happens when the person's
1:07:13in jail and they're getting out. Um this
1:07:16project is called before the bridge
1:07:18because that same person that had has
1:07:21end up in jail, his case is adjudicated.
1:07:24There was a point in his or her journey
1:07:27that there were probably multiple uh
1:07:30interactions with law enforcement or
1:07:32other community people. This person may
1:07:34have been homeless. They may have been
1:07:36panhandling. They may have been involved
1:07:38in a fight in front of [clears throat]
1:07:40those kind of things. This grant we hope
1:07:43to basically address the prevention and
1:07:46treatment and recovery and support of
1:07:48this person before they get inside the
1:07:50jail. This could be a general referral
1:07:53in the community. It could be a referral
1:07:55from law enforcement and would serve as
1:07:58a diversion. So instead of taking that
1:08:00person to jail, this would give other
1:08:03options for that working through
1:08:05Davidson Medical Ministries. So, we're
1:08:07here to answer any questions you might
1:08:09have on that and hopefully garner
1:08:10support for this valuable program. This
1:08:13grant does not require any match. So,
1:08:16there is nothing that's to being asked
1:08:18of Davidson County. Um, further, it
1:08:21actually even provides uh indirect cost
1:08:23that helps the county administer this.
1:08:26Uh I'm a very frugal taxpayer and I want
1:08:29to see uh as much assistance brought to
1:08:32the county as possible and uh if there's
1:08:35a way to uh do that uh not on the local
1:08:38taxpayers's dime at the federal level uh
1:08:41I think it's a wonderful idea.
1:08:43>> What's the value of the grant?
1:08:45>> Uh it can be up to 1.3 million.
1:08:48>> Okay.
1:08:49>> Wow.
1:08:51>> Okay. Any questions from anyone?
1:08:55Is that what we're seeking is the 1.3
1:08:57>> the budget? It would be right at that
1:08:59that threshold. Maybe not exactly 1.3,
1:09:02maybe just a hair under. There's still
1:09:03some. We're still It's not due until
1:09:05October 1st. We're still creating that.
1:09:07Yeah.
1:09:08>> You're asking for letters of support.
1:09:10That's all
1:09:11>> a letter of support. And there is a
1:09:12formal letter that the uh grant
1:09:14requires. It's a a formal form. So, it
1:09:17would just be that the county uh
1:09:18supports that because the county is the
1:09:20one accepting the grant. Uh, it has to
1:09:22go it has to go to municipalities. It's
1:09:25not available to nonprofits. Okay.
1:09:28>> You say this is before the jail. So,
1:09:30will you be working closely with law
1:09:32enforcement on
1:09:34biggest problem I've got, not with your
1:09:36what you're doing, but where are you
1:09:38going to put these people?
1:09:40>> This is hopefully a diversion type
1:09:43program that would also incorporate
1:09:45working with uh the judges. There's
1:09:47always been there has been agreements
1:09:48and support written uh from them that
1:09:51they're going to do this in lie of
1:09:53putting them in jail. This these are
1:09:55this is a diversion activity hopefully
1:09:57before they get to that point that we're
1:09:59going to try to reach them on the front
1:10:01end versus the bridge project which
1:10:03addresses it after they're in
1:10:05>> again. Where are you going to put these
1:10:07people?
1:10:10>> Can you explain that? Where as where are
1:10:13you going to put
1:10:13>> you said other than jail. So, what are
1:10:15you what are you going to do with them?
1:10:16>> So, we would connect with them when they
1:10:18say that they're um having substance use
1:10:21issues and they're looking for help. And
1:10:23so, if they can't find some place right
1:10:25here in Davidson County, then we're
1:10:27going to connect them to resources to
1:10:29help them move from crisis to hope to
1:10:32long-term sustainability. So, we have a
1:10:35list of over 14 different places that if
1:10:37someone's looking to get treatment that
1:10:39we can help them to get to that place.
1:10:41And so it's breaking down all the
1:10:43barriers that they say are here so they
1:10:46can get there.
1:10:48>> Yeah. I don't have any problem with
1:10:49that. But I'm just concerned about
1:10:52there's no place to put these people
1:10:55there. I mean you got to send them I got
1:10:57people in Hendersonville
1:11:01because you can't find anywhere local to
1:11:03put them. And so that's for what my
1:11:06concern is. I weren't you going to spend
1:11:07some of that money and trying to prepare
1:11:11a place to put these people, but if
1:11:13you're not going to send them to jail,
1:11:15you're going to send them somewhere. So,
1:11:17what are you going to do with
1:11:18>> So, we'd like to help them to get to a
1:11:20long-term treatment and to get to the
1:11:23appropriate treatment. If they can't get
1:11:25it here locally, then take them to a
1:11:27place where they can get
1:11:28>> that going through court order.
1:11:30>> We'd like to get to them before they get
1:11:32to the court order. And so, um, the
1:11:35opportunity is when people drop off,
1:11:37we'll just say narcotics or scheduled
1:11:39two substances to put them in a, um, a
1:11:42dropbox at our office or in other places
1:11:44we have them in the county. Then we have
1:11:46the opportunity to make a connection
1:11:48then to say here are the resources
1:11:51available to you and to connect them
1:11:54with over 60 partners,
1:11:56>> that information to the person, the
1:11:57individual. And so you depend on a
1:12:00person that's an opioid addict to go
1:12:02find these places.
1:12:04>> No. Once we connect with them, then
1:12:06we're going to walk with them and show
1:12:09them, tell them where they can go. And
1:12:13as much as they'd like us to walk with
1:12:15them, we're going to continue until they
1:12:17get to a place where they're no longer
1:12:19in crisis.
1:12:20>> You know, those people that at that
1:12:21stage are going to need some help. Yes.
1:12:23>> Can't just hand them a letter and say,
1:12:24"Go here." You know, that's not going to
1:12:26work. and you know it's in our health
1:12:28work.
1:12:28>> So we have community health workers and
1:12:30then peer support specialists that we
1:12:32would connect them with to help them to
1:12:34walk alongside them from crisis to hope
1:12:37to long-term sustainability.
1:12:39>> Could you tell me what it cost uh on
1:12:41average to treat somebody?
1:12:45>> It depends on if they're going to a
1:12:4628-day program or if they're going to a
1:12:49two-year program. And it depends. I
1:12:51mean, frankly, it depends on what level
1:12:54of care and if they're working with them
1:12:56to get to a job, if they've already
1:12:58detoxed, it depends on what space
1:13:00they're in. We know that for a 28-day
1:13:02program, traditionally, it costs right
1:13:04around $30,000.
1:13:06>> Okay. For a two-year program,
1:13:09>> well, a lot of the two-year programs
1:13:11that we are seeing the people that we're
1:13:13serving going to are work program. And
1:13:16so they start 60 days without working.
1:13:20They start in programs and then they pay
1:13:22for their program the rest of the time.
1:13:24>> So what is a 60-day program?
1:13:27>> Right around
1:13:29I believe it's right around $47,000.
1:13:31>> 47.
1:13:33>> So about a,000 bucks a day. I guess kind
1:13:37of sounds like the average on what time
1:13:39they spent. Okay. Thank you very much.
1:13:41>> I'd just like to tell you I think this
1:13:43is a no-brainer. I think anything that
1:13:45would not require a county match and any
1:13:48any organization that can bring money
1:13:51into our county to fight abuse and and
1:13:54can give people a chance to stay out of
1:13:56jail and to making new life for
1:13:58themselves, we need to be doing. I
1:14:00commend both of y'all for coming before
1:14:01us and doing that. And I think it's a
1:14:03no-brainer and you have my support.
1:14:07>> Any other comments?
1:14:09>> Let's hope it's we get very positive
1:14:11results. Is there the possibility for
1:14:13any kind of renewal or is it like a lump
1:14:16sum one time only? [clears throat]
1:14:18>> This is a three-year grant. So, the uh
1:14:20the process of this would be three
1:14:22years. The great thing and the thing
1:14:24we're really going to be um hoping for
1:14:27is that both of the grants would get
1:14:29approved so that we could have sort of a
1:14:31dual approach, a double-headed spear, so
1:14:34to speak, to do that. That both of those
1:14:36are uh within three years. Uh COUP does
1:14:39offer renewal grants. We just can't say
1:14:42we're doing the exact same thing. We
1:14:43would have to be innovative and expand
1:14:45uh create a program that walks in lock
1:14:48step with it, but has has different uh
1:14:50goals and objectives in the future.
1:14:52>> Well, and I'll echo Commissioner Elliot,
1:14:54you you have my support on this as well.
1:14:57>> Do we need to go ahead and make a motion
1:14:58to
1:14:59>> I got one other question, please. One
1:15:01point. It's a three-year grant. Is that
1:15:031.3 million per year or is this for the
1:15:05total?
1:15:06>> Yeah.
1:15:07>> Okay.
1:15:10Any other questions?
1:15:12>> All right. I think I'm I think we're
1:15:13ready for a motion.
1:15:14>> Make a motion we get them the letter
1:15:16they need to proceed with the grant.
1:15:18>> Do I have a second?
1:15:20>> I'll second.
1:15:20>> Okay. All in favor say I.
1:15:22>> I.
1:15:22>> I.
1:15:25>> Thank y'all.
1:15:26>> I'll let you know when I've got it
1:15:27ready. [clears throat and cough]
1:15:33>> All right. Next, we have an appointment
1:15:35to the board of adjustment. Mr. Rickard
1:15:37and [snorts] Mr. Jones.
1:15:39>> Madam Chair, um if you've got your
1:15:43agenda item on August 10th, you
1:15:44appointed Christian Jones as an
1:15:46alternate to the board of adjustment.
1:15:49Uh he is we've determined he can't serve
1:15:52on both boards. So we need an individual
1:15:54or uh to serve as an alternate on the
1:15:56board of adjustment.
1:15:58>> That's the two applicants we have on our
1:16:01>> We have Doug Hunt and Bobby.
1:16:04>> Yeah. Great.
1:16:06I'm not sure.
1:16:10Do any of you all know this gentleman?
1:16:12And Doug?
1:16:13>> I don't know either one. Doug. Huh?
1:16:15>> Yeah, we know Doug.
1:16:17>> Doug serves on the DSS.
1:16:18>> DSS board.
1:16:19>> DSS board. You like Doug?
1:16:21>> I do.
1:16:22>> Mhm.
1:16:23>> I'll make a motion we approve Doug.
1:16:24>> Second.
1:16:25>> Okay. Have a motion, a second. All in
1:16:27favor say I.
1:16:28>> I.
1:16:28>> Thank you very much.
1:16:32>> All right. We'll begin the public
1:16:34hearing. Here comes Mr. Crook.
1:16:49Welcome back.
1:16:54The first one's been withdrawn.
1:16:55>> Mhm.
1:16:56>> While he's getting ready, I'll go ahead
1:16:58and The reasoning request for number A
1:17:01has been withdrawn. So, there's nothing
1:17:04to hear there. So, we're going to move
1:17:06on to item B. Uh, while he gets ready.
1:17:10>> I'm ready when you are, Madam Chair.
1:17:11>> Okay.
1:17:12>> All right. Um, thank you. Good
1:17:15afternoon, Madam Chair, fellow
1:17:16commissioners. Um, our first resoning
1:17:19item of the night is a request by
1:17:21Deborah B. Lewis to reszone property
1:17:23located in Abs Creek Township, tax map
1:17:2616, lots 3C, and a portion of lot three
1:17:29containing 1 acre, more or less. said
1:17:31property is located on the west on
1:17:33excuse me on the north claudefelter road
1:17:35approximately 045 miles north of the
1:17:38from the Willie Boingheimer road uh
1:17:40intersection reszoning is requested to
1:17:42change from that of CZRC conditional
1:17:44zoning rural commercial to that of RA3
1:17:47rural agricultural district if the board
1:17:49will recall about a year ago um
1:17:53Mrs. Lewis's husband came before the
1:17:56board and successfully reszoned the
1:18:00property highlighted in yellow. If you
1:18:01please divert your attention to the uh
1:18:03overhead for a small automotive sales
1:18:07lot.
1:18:08>> And apparently that that has not panned
1:18:11out. And now they hope to reszone it
1:18:13back to RA3 for agricultural purposes.
1:18:16Um Miss Lewis is uh in the audience and
1:18:20um I'll let her explain the rest of her
1:18:22application. going back down.
1:18:24>> Thank you, love.
1:18:29>> Hey, I'm Debbie Lewis. Um, like you
1:18:31said,
1:18:32>> you want to open the public hearing?
1:18:33>> Yes, let me open the public hearing,
1:18:35please. No, you [clears throat] can
1:18:36tell.
1:18:37>> Okay. Um, like you said, the car lot
1:18:40didn't go very far. Waste of time. But
1:18:43anyway, uh, so I would just want it to
1:18:45return back into the original 44 acres,
1:18:49I think it was. That 44 acres has been
1:18:52in my home as farmland for over a
1:18:56hundred years.
1:18:57>> Okay.
1:18:58>> Okay.
1:19:00Any questions by the board?
1:19:01>> I don't have any.
1:19:03>> I think this is
1:19:04>> I think
1:19:05>> I think this is great. Is there anyone
1:19:08in the audience who wishes to speak
1:19:10either in favor of or opposition to this
1:19:12request?
1:19:15>> Hearing none. I think I can declare the
1:19:18public hearing closed. Yes, ma'am.
1:19:20>> Mr. Crook, what is your recommendation?
1:19:22>> Uh staff's going to support the the uh
1:19:24application citing contiguous uh the
1:19:28fact that the properties contiguous on
1:19:30all sides to RA3, which uh complies with
1:19:33article 7, administration of our zoning
1:19:35regulations. And I'd like to site
1:19:37policies 116, 5.1, 53, 54, 555, 56, 57,
1:19:4258, 510, and 73 of our adopted land
1:19:46development plan, which will support the
1:19:49applications. staff would recommend
1:19:50approval.
1:19:51>> Okay.
1:19:52>> Motion to approve.
1:19:53>> I've got a motion
1:19:54>> on statement of consistency and I second
1:19:56that. Amen. [laughter]
1:19:57>> Thank you, gentlemen. I have a motion
1:19:59and a second. All in favor say I.
1:20:01>> I.
1:20:02>> Thank you.
1:20:03>> Thank you.
1:20:04>> Congratulations.
1:20:06>> All right. Item [clears throat] number C
1:20:09is reszoning request. Mr. Crook.
1:20:11>> Thank you.
1:20:12>> Before Before you get started, I want to
1:20:14discuss something with uh our county
1:20:17attorney here. Uh my business does some
1:20:21business with group 21.
1:20:23>> Okay.
1:20:24>> Uh I just want to make that known to the
1:20:26public. I don't have any financial
1:20:28interest
1:20:29in this particular zoning.
1:20:32Um I do serve on the airport uh board
1:20:35with uh Mr. Cochran.
1:20:38That has no direct conflict with this u
1:20:43zoning request.
1:20:45Uh just to give my fellow board members
1:20:48an example of how much business maybe I
1:20:51do with Mr. Cochran, we probably do the
1:20:54equivalent of maybe 20 loads of stone a
1:20:57year.
1:20:58Uh and I haul about 20 to 40 loads of
1:21:01stone a day in asphalt in my business.
1:21:04So I think I had my girl to pull it up
1:21:06today and we've hauled the equivalent of
1:21:09like 20 loads of stone.
1:21:11I want to get your opinion on the
1:21:13recusal because we have a duty up here
1:21:15to do
1:21:16>> as a voting member. But so
1:21:20>> Sure. Yes. Um so this is governed
1:21:24recusal for zoning matters is governed
1:21:28under the um North Carolina general
1:21:31statute 160D-109A
1:21:35and recusal
1:21:37um is appropriate um if the board member
1:21:43has a close familiar familial like being
1:21:46related
1:21:48business or other associational
1:21:50relationship. ship um with the the party
1:21:53making the application.
1:21:55Um
1:21:57so it's
1:22:00in in this in this matter I I mean it's
1:22:02would be up to the board to decide
1:22:05whether whether
1:22:08[clears throat] Mr. Yates's
1:22:10um business relationship as he's relayed
1:22:14um you know has would would rise to the
1:22:17level of a close business relationship
1:22:21um that would that would require
1:22:24recusal.
1:22:25>> What's your legal opinion?
1:22:27>> Um because it well Mr. I I guess I'm
1:22:32going to ask you is it is is there any
1:22:36do you have any expectation that this is
1:22:38that that if this is approved that
1:22:40you're going to be doing any of the work
1:22:42on this part on this particular project
1:22:44or or the other project that's going to
1:22:46be heard in just a minute.
1:22:48>> I don't know anything about either one
1:22:49of these projects. So um Mr. Cochran
1:22:52does his own grading from my
1:22:54understanding.
1:22:56Um so we wouldn't be doing any grading.
1:22:59We haven't done any grading for him in
1:23:00the past. Uh I know him for for years.
1:23:04Okay. Like I know a lot of people for
1:23:06years in this county. So
1:23:07>> Okay.
1:23:08>> But no, I have no intentions of doing
1:23:10any work for it on it or any of them. So
1:23:14>> Okay. Either either this project or the
1:23:17next one that we'll be hearing. So, so
1:23:19it doesn't, you know, this does not
1:23:20sound like the kind of direct and
1:23:23substantial, you know, financial impact
1:23:26that would require recusal. I mean,
1:23:29that's I I read that the um I read the
1:23:33the uh the standard
1:23:36um that it would be a a close familial
1:23:40business or other relationship that
1:23:42would be appropriate for recusal. And so
1:23:46it would if um you know I I would
1:23:50recommend that the the board um
1:23:55go ahead and vote on on whether on on
1:23:57whether based on that standard Mr. Yates
1:24:00should be recused from this vote and
1:24:02this vote and the next one.
1:24:04>> Yeah.
1:24:04>> So here can I make a point to you and
1:24:07tell me because
1:24:08>> I don't want to get caught up in
1:24:10anything. If you increase the the zoning
1:24:13from RA3, RA 1, RA2 to commercial, does
1:24:19not that also increase his ability to
1:24:23improve his business?
1:24:26>> Yes.
1:24:26>> Excuse me.
1:24:30>> I don't think I I don't think I
1:24:31understood. Are you talking about
1:24:33>> can he not
1:24:35elevate the level of business he does
1:24:38under commercials?
1:24:40Well, yeah. I mean, if so, if this I
1:24:42mean, if the reasoning is granted, then
1:24:44then he would be able to do
1:24:46>> more
1:24:47>> more on the property. Yes. I mean,
1:24:49>> he's and if Commissioner Yates is
1:24:51selling if you're selling him gravel, I
1:24:53I recuse myself. I'm I would
1:24:58>> I mean, that's fine with me, but I'm
1:25:00saying I have no direct benefit to this
1:25:02job or any other job, you know.
1:25:04>> But I thought you sold him every year.
1:25:07No, I said I sold him probably
1:25:09equivalent of 20 loads this year, but it
1:25:11could be I mean
1:25:13>> Oh, you don't you're not on continuous
1:25:16>> He's got his He's got he's got his own
1:25:18dump trucks and every now and then he'll
1:25:20call. So, I guess
1:25:22I in a in a reference I haul 30 or 40
1:25:25loads of asphalt and rock a day. So, you
1:25:28know, I have multiple people out here in
1:25:30this county that may call and get five
1:25:32loads of rock or
1:25:33>> 10 loads and
1:25:35>> here and there. Well, I was wanting a a
1:25:37legal representation of that because you
1:25:39know this isn't trivial like that they
1:25:42commissioners could recuse themselves of
1:25:44voting on unpopular things all the time
1:25:47just to say facing the community but it
1:25:49is a requirement that you vote on things
1:25:52that you have to vote on that you are
1:25:54not legally recused of. So that's why I
1:25:56wanted the illegal opinion before we
1:25:59vote on this because legally he is
1:26:01required to vote on things that is not
1:26:04up to a legal recusal. So right that's
1:26:07why we need the legal opinion as a
1:26:09board.
1:26:10>> How do you feel?
1:26:11>> Well, that's so that's that's correct.
1:26:13So if there's I mean you're you're all
1:26:15required to vote on any business that
1:26:17comes up.
1:26:17>> Yes. um unless unless there's you know
1:26:20an impermissible interest that's stated
1:26:23in the statute and one of that you know
1:26:26one of those is the one I just read. Um
1:26:29you know as I said I don't this this
1:26:32does not seem to be the the kind of
1:26:34direct and substantial you know
1:26:38financial interest in this in this
1:26:40particular
1:26:42matter that's before the board that
1:26:44would um that would require recusal. I
1:26:47mean, but that's I you know, this is
1:26:50this is something that there there's
1:26:52very little case law on on,
1:26:54you know, where I I can't throw you an
1:26:56example and say, "Oh, this happened, you
1:26:58know, this happened 10 other times and
1:27:00and this is how it worked out." It just
1:27:01there's just not that kind of case law.
1:27:04So,
1:27:04>> I mean, you you have to just apply that
1:27:07the standard from the
1:27:09>> Okay.
1:27:09>> And and you know, and and um you know,
1:27:12and decide whether you think recusal is
1:27:14required or not. That's why I wanted
1:27:16legal opinion. Okay. Because
1:27:18>> That's right.
1:27:18>> I' I've been hailed to vote for things
1:27:20before just like just like this, you
1:27:22know? I mean, because I mean I my
1:27:24family's lived in this county since
1:27:261820. So, we do business for people in
1:27:28this county.
1:27:29>> Just to explain what my question was.
1:27:32Initially, I misunderstood
1:27:35what he if I correct me if I'm wrong,
1:27:37Commissioner, he done a prior sale.
1:27:41>> It's not anything as continuous or
1:27:43ongoing. So, I think I I withdraw my
1:27:46request for them.
1:27:47>> Again, I want to explain it. It's not
1:27:48like I do grading for them on every
1:27:50project they do or any project they do.
1:27:52I've never done any grading on any
1:27:54project. So, uh we're in the grading
1:27:56business. We're in the paving business.
1:27:57I've never paved a project for this
1:27:59gentleman. So, I just want y'all to know
1:28:02so y'all can decide whatever you want.
1:28:04But, uh
1:28:06>> there's no standing contract.
1:28:07>> No,
1:28:10>> I misunderstood. I thought he had a
1:28:12normal one.
1:28:12>> No.
1:28:13>> Any other questions? Anybody from
1:28:15anybody?
1:28:16>> Madam Chair,
1:28:16>> so y'all y'all do as y'all see fit.
1:28:18>> Do you have any questions?
1:28:19>> I don't.
1:28:20>> Okay. So, are are we okay with allowing
1:28:25>> Can you can you just vote Can I Can I
1:28:27just get a motion?
1:28:28>> I have a motion. Do I have a motion on
1:28:29whether whether [clears throat] to
1:28:31recuse
1:28:32>> to recuse him or or or not?
1:28:34>> Right.
1:28:35>> Okay. So, do I have a motion?
1:28:37>> Hold on. Are you wanting to be recused
1:28:40or you're not wanting to be recused that
1:28:43>> I want to follow the law whatever the
1:28:45law is. So
1:28:46>> I was just curious where where your
1:28:48feelings were on that too.
1:28:49>> I want again I I've voted for a lot of
1:28:52things
1:28:53>> in the past. I would love to been
1:28:55recused of but I have an obligation up
1:28:57here to vote
1:28:58>> on it. So
1:28:59>> now I think you do now.
1:29:00>> Right. So again I have no financial
1:29:02interest in this project or this project
1:29:05the other. So
1:29:07>> our vote to explain this is he is
1:29:09required to vote
1:29:11>> not a choice to recuse himself. If
1:29:14there's no legal president to deny him
1:29:16from voting, you are required to vote.
1:29:18And I think if you cannot provide that,
1:29:20then our vote has to be yes to let him
1:29:22vote because he is required.
1:29:26>> Mr. Sh, do you have a question?
1:29:28>> No, I'm good.
1:29:29>> You're good, everybody. Okay. Okay. So,
1:29:32we're we're seeking a motion
1:29:33>> motion to allow Commissioner Yates to
1:29:36vote on this zoning report.
1:29:38>> I have a motion to approve
1:29:39>> I would say on this this one and the
1:29:40next
1:29:41>> and the next one. Yeah. And the next
1:29:42one.
1:29:43>> Yeah.
1:29:43>> I would just add to the minutes per the
1:29:45attorney's explanation of the law. He's
1:29:48required to vote and and I'll second
1:29:50that.
1:29:50>> Okay. So, we have a a motion and a
1:29:53second. All in favor say I.
1:29:54>> I. I.
1:29:57>> Opposed.
1:29:57>> I recuse myself from that vote. Okay.
1:30:00[laughter]
1:30:02Okay. So,
1:30:06>> who's talking out there?
1:30:08>> I I don't know. There seems to be
1:30:11>> quite I don't think they really
1:30:12understand the law, but we
1:30:15>> Erin, would you consider, you know,
1:30:18making giving them the eye or something
1:30:20to, you know, we're we're trying to
1:30:23carry out business. It's
1:30:26this is not this is not a place for you
1:30:29to be talking during our business. Okay.
1:30:32>> Well, and for for just for context, too,
1:30:34it it'd be different if there was an
1:30:37ongoing contract that he had with this
1:30:40company.
1:30:40>> Amen.
1:30:41>> There's previous work that had been
1:30:43done. So, there's I don't think any
1:30:45precedent where he should recuse
1:30:47himself. That's the standard that we
1:30:49used.
1:30:50>> Amen.
1:30:51>> Okay.
1:30:53>> All right. So, I think we're ready, Mr.
1:30:55Group.
1:30:55>> All right. Thank you.
1:30:56>> Are we ready? [clears throat]
1:30:57>> I think we're ready.
1:30:58>> Okay. [laughter]
1:30:59>> I declare Well, um, you introduce and
1:31:01then I'll declare the public hearing.
1:31:03>> Our our second request of the night is
1:31:04by Group 21 LLC to reszone property
1:31:07located in Cotton Grove Township, tax
1:31:10map 13, lot 26, containing 7.33 acres
1:31:14more or less. said property is located
1:31:16on the north side of Belmont Road
1:31:19approximately 8,500s of a mile west of
1:31:21the Lynwood Southmont Road intersection.
1:31:24Reszoning is requested to change from
1:31:26that of RA1 and RA2 rural agricultural
1:31:29districts to that of CZRC
1:31:32conditional zoning rural commercial
1:31:34district. If you would briefly divert
1:31:36your attention to the overhead to get
1:31:38you acclimated with where this property
1:31:40is located. This this is Belmont Road.
1:31:42These are the eastern lots of the I85
1:31:45corporate center. Edgars is just off the
1:31:47map to the left. Um the property
1:31:51highlighted in yellow is the property in
1:31:53question tonight. If you move off to the
1:31:55east, then you've got Lynwood Southmont
1:31:58Road just off the map on this side. Um
1:32:01this application is represented by
1:32:03attorney Leedra Matthews. And uh once
1:32:06Madame Chair opens the public hearing,
1:32:09invite her up to explain the
1:32:10application. I declare the public
1:32:12hearing open. Will the representative
1:32:14come forward and explain the request?
1:32:16>> While she's walking up with Lee, will
1:32:18you show me uh where Edgar's at?
1:32:21>> Edgar is just if like
1:32:24right here is the roundabout
1:32:28>> just to the west of this and Edgar would
1:32:30kind of be
1:32:32just the same.
1:32:34>> Pardon? [clears throat]
1:32:34>> Same side.
1:32:35>> It's on the opposite side of the road.
1:32:36Yes, sir. It's on the It's on the north
1:32:38side of Belmont Road where Edgar and the
1:32:40corporate centers to the south.
1:32:44>> We're ready. Go ahead.
1:32:48>> Good evening, chair and commissioners.
1:32:51>> My name is Ludra Matthews. I am an
1:32:53associate attorney with Box Rosschild
1:32:55office address 101 South Triion Street
1:32:59in Charlotte, North Carolina. Again, I'm
1:33:01here on behalf of the applicant group
1:33:0321. Jonathan Cochran is also here on
1:33:06behalf of group 21 to answer any
1:33:08questions you might have after our brief
1:33:11uh presentation.
1:33:28[clears throat]
1:33:30[sighs]
1:33:32>> Mr. Crypt did a great job of um
1:33:35explaining the request overview. So I'll
1:33:37try to be brief. Uh the parcel is um a
1:33:42split jur a split jurisdiction, not
1:33:44jurisdiction, split zoning, RA1 and RA2
1:33:47towards the back of the property or
1:33:49towards the east. We're asking for
1:33:50conditional zoning um residential
1:33:53commercial. It's about a little under an
1:33:548 acre property to allow for the
1:33:57construction and use of a self storage
1:33:59facility.
1:34:04These are the parcels. This is a a
1:34:06screenshot of the zoning map. As you can
1:34:09see, the blue and red um on your screen
1:34:12uh shows you residential zoning. Um you
1:34:16also have that red um that shows some of
1:34:20your heavy industrial and um even more
1:34:23residential commercial in the area. And
1:34:25I had this slide up just to show you
1:34:27that it is a largely residential area,
1:34:29but there is several there are several
1:34:31industrial and commercial uses and they
1:34:33all um operate in harmony in this area.
1:34:36And I think that that mix of uses uh is
1:34:39well I know that that mix of uses is due
1:34:41to proximity to Highway 85, Highway 47.
1:34:46uh self- storage would allow um an added
1:34:49service to these surrounding residential
1:34:51uses, but for reasons that I will um
1:34:54explain in just a few slides, it's more
1:34:57it's compatible with this area um and at
1:35:00a an appropriate intensity.
1:35:04Here's another slide. This is an aerial
1:35:06that shows you some of those surrounding
1:35:08areas Mr. Crook Croh pointed out. Um,
1:35:11our site is shown here with that yellow
1:35:14star and around you see to the south we
1:35:17have Norfolk Southern. You also have um,
1:35:20Edgar as Mr. Crook pointed out as well
1:35:22as the I85 corporate center to name a
1:35:25few.
1:35:32This is a concept map. You'll see the uh
1:35:35warning there or um caveat qualification
1:35:38that this is conceptual in nature
1:35:41intended to illustrate the plan for uh
1:35:44this area but is not offered as a
1:35:47condition. The site plan or the
1:35:48condition concept plan itself is not
1:35:50offered as a condition. Um but you see
1:35:52the idea or vision that group 21 has a
1:35:56series of about five buildings laid out
1:35:5824 ft drive aisles in between each
1:36:02building. You'll see towards the uh
1:36:04southern portion um areas designated for
1:36:07Amazon parcel. Um I think those might be
1:36:10lockers or pickup for Amazon parcels as
1:36:14well as a ice and vending machine.
1:36:16Again, this site plan is not um set in
1:36:20stone and the applicant has included
1:36:22these uses, specifically the Amazon
1:36:24parcel and the ice vending machine
1:36:26because if they are not um presented to
1:36:29you during the resoning and we were to
1:36:31add them later, we would have to come
1:36:33through the process again.
1:36:37Also, there will be gated access here
1:36:39and all of the storage uh storage
1:36:41buildings are singlestory.
1:36:50This is a rendering of what the
1:36:52buildings will look like from Belmont
1:36:54Road. Again, uh it's to depict the
1:36:57elevations or the division now, but this
1:36:59is again not a uh condition
1:37:03offered with the application
1:37:08following the planning board meeting or
1:37:10at during the planning board meeting. an
1:37:12additional condition um was profered due
1:37:16to planning board comments and concerns
1:37:18or feedback um and that is um about the
1:37:22lighting in the area. Again, it does it
1:37:24is adjacent to a residential area and
1:37:27planning board members were concerned
1:37:29about light pollution on Belmont Avenue
1:37:32as well as to uh nearby residents
1:37:35residences. So, this is the um the
1:37:38language that we have worked with
1:37:39planning staff um to mitigate the the
1:37:43light impact.
1:37:46I'll leave it there for a second so you
1:37:47can read it and I won't be reading it to
1:37:49you, but
1:37:53the lighting will comply with NC DOT and
1:37:56North Carolina state building code. Um
1:37:58but where possible and adjacent to the
1:38:00roads or adjacent to the road or
1:38:02residential properties there will be
1:38:05house side shields equivalent shielding
1:38:07to again mitigate that pollution.
1:38:16These are the various factors um
1:38:18mandated by North Carolina statute 160D
1:38:22as well as your zoning ordinance. the
1:38:25specific factors you are to consider
1:38:26when considering a resoning. So, I'll
1:38:29take each of those in turn briefly. So,
1:38:32with regard to size and physical
1:38:33location, this site was um evaluated by
1:38:38a professional and found that there were
1:38:41no suitable soil in the area um in order
1:38:44to perk or to support a conventional
1:38:46septic system uh needed for residential
1:38:49development. Again, this is a
1:38:50residential existing residential zoned.
1:38:53Um, but it will not perk for residential
1:38:55use.
1:38:59With regard to number two, the impacts
1:39:02on neighbors and the surrounding
1:39:03community. As I've alluded to, it's a
1:39:05low impact commercial use. It doesn't
1:39:08generate much if at all traffic noise um
1:39:11in places virtually no burden on public
1:39:13services. Um, we'll use very little
1:39:16water here. And Mr. Cochran can talk to
1:39:19you about the specific water usage on
1:39:22the site. Um but it will not constrain
1:39:25or add um add more impact to the traffic
1:39:29in the area.
1:39:32On the other hand, it is self- storage
1:39:33and we did see that map of residential
1:39:35residential uses in the area and is
1:39:37adding a service to those um to the
1:39:40residential areas in the community. With
1:39:43regard to number three, permitted versus
1:39:45requested uses. Again, we're talking
1:39:47about what not only was permitted, but
1:39:48was practical. Again, the the soil did
1:39:51not perk, so it's not suitable for uses
1:39:53in the residentially zoned district.
1:39:57With regard to factor number four,
1:39:58public interest, we talked about the the
1:40:01potential benefit of a self storage in a
1:40:03in this area. Um, and on the other hand,
1:40:06well, I'll stay here for a minute and
1:40:08talk about the public interest. It would
1:40:10also be providing infill development in
1:40:12an otherwise underutilized tract. Um the
1:40:15tract is currently vacant and again we
1:40:17know it cannot be used for residential
1:40:19use that it is um existingly zoned for.
1:40:23And number five, change conditions. I
1:40:25won't spend too much time on there. I'm
1:40:26preaching to the choir. Thanks to your
1:40:28efforts and the county efforts, there
1:40:30has been a significant industrial boom.
1:40:32People are coming to Davidson County um
1:40:35at unprecedented unprecedented rates.
1:40:38Um, and this is a unique um, resoning
1:40:42that again will have very minimal
1:40:44impact, very minimal strain if at all on
1:40:47existing infrastructure. Um, but make
1:40:49good use of of the property um, at again
1:40:53a low intensity that will be in harmony
1:40:56with the the surrounding uses.
1:41:05You and I know that you do plan for the
1:41:07future and one of the pieces of evidence
1:41:10of that planning for the future is the
1:41:11Davidson County Land Development Plan.
1:41:14Um the plan promotes orderly growth and
1:41:16the coordination of land uses with
1:41:18existing infrastructure.
1:41:20We've talked about the location of the
1:41:22site. It sits near Interstate 85. It is
1:41:24bordered to the south by Northick
1:41:26Southern Railroad surrounded by that mix
1:41:29of vacant farmland and further east
1:41:31chemical and manufacturing operations
1:41:33that we pointed out.
1:41:37we be locating a quiet low impact
1:41:39commercial use like self- storage and a
1:41:41transitional area. So you see towards if
1:41:43you look at this map that is also from
1:41:45the development plan and I don't know if
1:41:47you're able to to see the colors too
1:41:49well but again our site is shown by the
1:41:52yellow star
1:41:55clo uh further north you have more
1:41:57intense uses um and they slow down a
1:41:59little bit or at least in this area in a
1:42:01residential area. So, we think that self
1:42:03storage strikes a good balance and
1:42:04serves as a transitional area from the
1:42:07heavier, more industrial uses to the
1:42:09south. Um, and it's also, as noted on
1:42:12here, this is an approximate location.
1:42:15So I can't say with 100% confidence that
1:42:17the site is actually within the
1:42:19commercial and industrial center but
1:42:21based on my eyeball of the site plan or
1:42:24of this map and the site it is there if
1:42:29not in close proximity to a commercial
1:42:31industrial um corridor.
1:42:34You also have several um policies from
1:42:38the economic development portion of the
1:42:40land development plan uh that would
1:42:42support this resoning. Those are listed
1:42:45there. Mr. Crook um and staff do a great
1:42:48job of compiling those for you and he'll
1:42:50read those to you later. So again, I
1:42:52will not bore you with reading from the
1:42:53the slide.
1:42:57[clears throat]
1:43:02This was uh the reszoning request uh
1:43:05received a recommendation of approval
1:43:07from planning board uh support from
1:43:09planning staff and so this evening we're
1:43:11asking for uh a vote to approve it.
1:43:13We're happy to answer any questions that
1:43:15you have.
1:43:17>> Any questions?
1:43:18>> Madam Chair, I don't have a question
1:43:19necessarily for y'all, but for Mr.
1:43:21Crook, uh, this past the this this
1:43:25passed the board by 50 at the planning
1:43:27board meeting. Nobody spoke with it. I
1:43:30know there was an extensive talk in the
1:43:31lighting and y'all handled that. I'd
1:43:33just like to give a shout out to the
1:43:35planning board for that. And I would
1:43:36also like to give a shout out to y'all
1:43:38for handling those lighting discussions
1:43:40prior to you coming before us. I was
1:43:43reading the notes and I appreciate your
1:43:44willingness to address those. That's all
1:43:47I had, madam chair.
1:43:48>> Thank you.
1:43:48>> Thanks, sir.
1:43:49>> Anyone else?
1:43:50>> Two questions. One, uh, Lee, based on
1:43:54that map, and I I would agree it looked
1:43:56like the star the location is in the
1:43:58commercial and industrial center. Can
1:44:00you verify that?
1:44:01>> I I can uh that that's actually not the
1:44:06right location. Yeah, if we can if we
1:44:08can go back to my PowerPoint show,
1:44:10that's actually in the Carolina corridor
1:44:12now site. So, um,
1:44:15>> didn't do a great job eyeballing.
1:44:17>> No, that Yeah, it our our and and to
1:44:20Miss Matthews defense, our our land
1:44:22development plan is not a parcel
1:44:24specific plan. It identifies features
1:44:26and if the requested application is
1:44:29within the influence of that feature,
1:44:32you have to make a judgment call as to
1:44:33whether it's subject to the feature like
1:44:35the I 8564 intersection. If it's within
1:44:38a certain distance of that, you know,
1:44:41our plan says it should probably be
1:44:43commercial. So, it's it's not parcel
1:44:45specific, but um
1:44:47>> with uh go on one more, please keep
1:44:51going. Keep going. Right there. Right
1:44:54there. This um this this is actually
1:44:57that big yellow area is actually where
1:45:00the property is located. And if I can
1:45:03reach in my pocket and get my
1:45:05dump everything out on the We've got
1:45:08Belmont Road right here. The Edgars is
1:45:11located right here. The site's right
1:45:12there. So this whole area is cited in a
1:45:17industrial development corridor. So to
1:45:20answer your first question, that that's
1:45:22accurate. Okay. Thank you.
1:45:24Where's our box site at compared? We got
1:45:27a box site out there as well.
1:45:28>> The the box site is a little bit to the
1:45:31U. If we can go backwards. Um I don't
1:45:33have the
1:45:35>> Can we go back a slide or two? Because
1:45:37it's actually on the zoning map.
1:45:41>> Go back one right there. Box sightes
1:45:44right there.
1:45:44>> Okay.
1:45:47>> Seen the box site out there at our
1:45:49industrial park.
1:45:51There's a little small business located
1:45:53right here. There's our box site. These
1:45:55are both parcels that are part of the
1:45:57I85 corporate center.
1:45:59>> I think there's a new trucking company
1:46:00coming right there in one of those.
1:46:02Right. Right there.
1:46:03>> Yes, sir. Yes, sir.
1:46:05>> That track right there is also owned by
1:46:06Davidson County. I don't know if that
1:46:08was part of the
1:46:09>> It owned by Davidson County. It's zon
1:46:11residential, but it was on the initial
1:46:14purchase for the corporate center, but
1:46:16it hasn't been reszoned.
1:46:21Okay. If there are no other questions,
1:46:24um, is there anyone in the audience uh
1:46:27who wishes to speak either in favor of
1:46:30or in opposition to this request?
1:46:35>> And Chair Wer, I'm sorry. Before we are
1:46:37seated, I just um would ask for a
1:46:40reservation of brief rebuttal time to
1:46:42address any concerns or feedback brought
1:46:44up during the public hearing. Thank you.
1:46:51Can Can these questions be Can
1:46:54>> please come forward.
1:46:55>> Yeah, come on up.
1:46:59>> Is she in adjacent land?
1:47:00>> Another thing that's happening around my
1:47:02house. Um, your name?
1:47:04>> Oh, my name's Jessica Bruff. And um, the
1:47:08lighting, is it going to be LED or is it
1:47:10going to be soft lighting?
1:47:15>> Can you tell us where you live here
1:47:17compared? Well, I live a little bit more
1:47:18on Oldwood Road, but we travel this area
1:47:21and with Carolina corridor coming and
1:47:24you guys are fixing to plow down a whole
1:47:27mess of woods. This is yet another spot
1:47:30that's going to be paved and more
1:47:33animals are going to be dispersed into
1:47:35our neighborhoods. So, it's kind of, you
1:47:39know, there's that factor, too. Um,
1:47:42>> so you don't live adjacent to this? I
1:47:43don't live adjacent to it, but I live in
1:47:45this area. And there's a lot of people I
1:47:47know that live in this area. Um, but so
1:47:51whenever all these trees start getting
1:47:52tear down and everything else that's
1:47:55going to happen, the skunks are going to
1:47:57start coming out, the foxes are going to
1:47:59start coming out, the deer start to come
1:48:00out, and they're all in our yards, and
1:48:03they're all missing out places to go.
1:48:06But I was just asking about the
1:48:07lighting. That's that's really is it
1:48:10going to be soft lighting or LED?
1:48:12We're going to comply with the energy
1:48:14code, our electrical engineer that
1:48:16designed it if there is without
1:48:18>> because the soft lighting would help
1:48:19with the animals.
1:48:22>> Okay,
1:48:23>> that's I mean it's just kind of I mean
1:48:25we're fixing to get bombarded with a
1:48:27industrial site in in our front yards
1:48:30and then this is another thing that's
1:48:32going to be plowed down for more animals
1:48:35to not have a place to go.
1:48:38>> It's going to be tearing down.
1:48:39>> It's just the soft lighting would
1:48:41actually help. It's a I can discuss it
1:48:43with you after this, but it's that would
1:48:45help.
1:48:46>> And just just think about the wildlife
1:48:49and when you're doing this when you put
1:48:51the plants and things up. I know
1:48:53>> use natural plants for like the
1:48:55butterflies and the other animals in
1:48:58this area because we're fixing to really
1:49:01decimate a whole lot of wildlife and
1:49:04their natural habitats in the next 10
1:49:06years
1:49:08>> for profit.
1:49:09>> For profit. I mean, just I we can I I
1:49:13can I can give you my phone number. We
1:49:15can just discuss some stuff, but this is
1:49:17I mean, I know this is something small.
1:49:19This is a storage unit. It's when we got
1:49:21those houses coming up on Lynwood
1:49:23Southmont Road. We got those houses
1:49:24coming up on Junior Order Home Road. We
1:49:26got houses coming up on Brown Street. We
1:49:28got houses coming more houses coming up
1:49:30on Lynwood Road. I understand that these
1:49:32houses are small and we do they are
1:49:34going to need storage places. I do get
1:49:36that. But we have got to really start
1:49:38thinking about just growing. If we're
1:49:42going to do this, we need to do this
1:49:44right and we need to protect our green
1:49:47spaces and protect these animals that
1:49:50we're doing. Okay? I mean, I know it's a
1:49:53very small
1:49:54thing, but I'm just saying I appreciate
1:49:58it. Thank you for letting me speak. Yes,
1:49:59>> we're not allowed to engage.
1:50:01[clears throat] We're not supposed to. I
1:50:02will give you my card.
1:50:03>> Thank you. I appreciate it. Oh, we can
1:50:06get together and talk about things.
1:50:08>> Okay.
1:50:10>> Yes, sir.
1:50:12>> What I'm concerned about is this is an 8
1:50:16acre property. So, we're going to go
1:50:18from 8 acres of wooded area to 8 acres
1:50:21of tar. Okay. So, that's going to be
1:50:23like a heat dome right there. The bu the
1:50:27buildings have black roofs. Could we
1:50:29maybe change the roofs to be white to
1:50:31reflect the heat? We need to think like
1:50:34in advance of climate problems that
1:50:36we're going to have in this county
1:50:37because at the rate we're going, the
1:50:40more things we cut down, the worse it's
1:50:42going to get. So, if we could alleviate
1:50:44some of the heat, what are we going to
1:50:46do with the rain the rain runoff when it
1:50:49when it rains on 8 acres of tar, where
1:50:51is all that water going to go? Where did
1:50:53it where did the gutters going to take
1:50:54the water? Do you have guys have a plan
1:50:56for that? How come you guys didn't ask
1:50:59them about this stuff before we got to
1:51:00this point? That's another question I
1:51:02have. Like, why don't you guys come in
1:51:04with environmental questions before
1:51:07these people get their hopes up and come
1:51:09here and ask for changes of rules and
1:51:11regulations? Why aren't there a set of
1:51:14Davidson County environmental rules that
1:51:18everybody has to comply with?
1:51:22>> I'm sure I'm sure they wouldn't mind.
1:51:23>> Planning board. Did you go to planning
1:51:25board meeting and ask these questions of
1:51:27pimp?
1:51:28>> No, because I'm never invited to a
1:51:29planning board meeting.
1:51:30>> It's open. I mean, is it online? Yeah.
1:51:33>> Okay.
1:51:33>> It's open.
1:51:35>> Okay. Next time I will
1:51:36>> I I can I can maybe speak to that a
1:51:38little bit that the the zoning
1:51:40regulations will only allow for 30 or
1:51:4340% building coverage on the property.
1:51:46So, we can't we don't have a regulation
1:51:48speaking to your point of can Mr.
1:51:52Cochran if he purchases this property go
1:51:54in and clear the whole thing. We don't
1:51:56have anything in our our laws that state
1:51:58that. But with respect to how much
1:52:02building he can build on it, that would
1:52:03be limited to 30 or 40% depending on
1:52:06certain circumstances.
1:52:07>> Is there any stipulations where he'd
1:52:09have to plant some extra trees or extra
1:52:11bushes into the property to help
1:52:13alleviate some of the heat and some of
1:52:15the, you know, water runoff and
1:52:17everything else that we're worried
1:52:18about?
1:52:18>> We do have we do have buffering
1:52:20requirements uh in the ordinance.
1:52:22They're they're not they're not very
1:52:24substantial, but he would have to have a
1:52:26buffer between his non-residential use
1:52:28and any occupied residential property.
1:52:32>> Okay. [clears throat] But how do we get
1:52:34these things
1:52:36healthier and bigger and and make them
1:52:38more of a of a of a standard, a better
1:52:41standard instead of just minimal things?
1:52:43You know what I'm saying?
1:52:44>> Well, and this is a sales pitch for the
1:52:45future and it doesn't it's not relevant
1:52:47for anything tonight. Okay. our 2009
1:52:50land development plan um is basically
1:52:53we're going to have a review of that and
1:52:55an update this coming year and these
1:52:58concerns that everybody here is voicing.
1:53:01We need to hear about that. We want to
1:53:02hear about that during that process.
1:53:04It'll be a year-long process where we'll
1:53:06have advertised meetings. There'll be
1:53:09surveys and the concerns that rise to
1:53:12the top with the most people asking
1:53:15about those. You hear me reference land
1:53:17development plans. That's what happened
1:53:19in 2009. These were all issues that
1:53:22people wanted to see addressed. So, they
1:53:25addressed it. They put it in the form of
1:53:26a policy statement and we adopted it in
1:53:28the land development plan. That's
1:53:30getting ready to happen this year. So,
1:53:33we would welcome input. There'll be some
1:53:35surveys. There'll be all kinds of things
1:53:37that that uh several open meetings that
1:53:40folks can come to and we'd love
1:53:42>> they'll be here or at the board. They'll
1:53:43be advertised probably in different
1:53:45locations, I would imagine.
1:53:46>> I would just like to tell the public
1:53:49that if we have those meetings that they
1:53:53should come up because we're traveling
1:53:55down a very slippery slope where we have
1:53:58individuals telling you what type of
1:53:59roof you can have, what type of lights
1:54:02you can have on your property. And and I
1:54:04do not agree with that. I think that's
1:54:06more of a communistic socialistic view.
1:54:09And I don't like that. Well, I believe
1:54:11if you own your land and you build your
1:54:14house, there's no way I should be able
1:54:16to tell Trip what side what what kind of
1:54:19lights you put on the outside of your
1:54:21house or what kind of siding you put on
1:54:23it or what type of roof. Uh I think I
1:54:26think that's traveling into a place
1:54:28where you talk about rights.
1:54:30>> Chris, I know you have a hot for
1:54:32socialists and communists and all the
1:54:34isms and I know you're you're big you're
1:54:36a big
1:54:37>> flag waving American, which I love about
1:54:39you, but You're a little foxified
1:54:41>> about us when we
1:54:43>> you're you're a little foxified. All
1:54:45we're trying to do is protect the
1:54:46environment basically.
1:54:48>> And a corporation could do they could do
1:54:51minor changes to help the environment.
1:54:53We're not telling them to, you know,
1:54:54change the world. We're just telling
1:54:56them to be smart developing that piece
1:54:58of property. That's all.
1:55:00>> Okay.
1:55:00>> It's not socialist. It's not communist.
1:55:03It's just environmentalist.
1:55:05>> Okay. Is there anything else? Anyone
1:55:07else that would like to speak?
1:55:10>> Yes, I would.
1:55:12>> Um, you mentioned the uh study from
1:55:152009.
1:55:16>> Yes, sir.
1:55:17>> We haven't been practicing what we said
1:55:19we were going to do. In that study, we
1:55:22said we were going to have clean water.
1:55:25We said [clears throat] we were going to
1:55:26have clean air. And we haven't been
1:55:28doing all that good.
1:55:31>> Now, our citizens are concerned about
1:55:34this. Some of you may not believe in
1:55:37global warming, but a majority, I
1:55:40shouldn't say a majority, but there's a
1:55:41number of people here that do because
1:55:44science backs that that is happening.
1:55:48Now, what we want, what we want is for
1:55:52some kind of common sense rules when
1:55:56people want to develop the land. That's
1:55:59not unreasonable.
1:56:02>> Yeah. And it's not communist. In fact,
1:56:05it is de democratic as you can get. So,
1:56:09in any case, all we're asking is there's
1:56:13some benefits for the companies when
1:56:16they do put a a a lighter colored roof
1:56:19on their on their buildings because it
1:56:22reflects the heat and cuts down on their
1:56:25electric bills when it's hot as hell
1:56:29like it's been in the past few months.
1:56:32Although it's not global warming, it's
1:56:35still hot
1:56:37and they're paying electricity. And now
1:56:40you're saying, "Well, geez, since they
1:56:43got to pay a lot of electricity, we need
1:56:45to do power plant. We need pipelines."
1:56:49No, that's not it. Listen to what the
1:56:53people want. That's all we're asking.
1:56:56And if we're coming up with common sense
1:56:59solutions, it helps you, it helps us, it
1:57:03helps them.
1:57:05>> Thank you.
1:57:06>> Are you saying that you would require
1:57:08light colored roofs?
1:57:10>> No, I wouldn't make it a law. I wouldn't
1:57:13make it a law, but I'll tell you this.
1:57:16Number one, it makes sense. Number two,
1:57:18we could encourage them. Number three,
1:57:21are we giving them any tax incentives?
1:57:24>> Huh?
1:57:25>> Not that I know of. Not that you know
1:57:26of.
1:57:28>> Well, if you do decide to give them a
1:57:30tax incentive, in some cases it makes
1:57:33sense to do that. If you are going to
1:57:36give them a tax incentive, say, "Listen,
1:57:38do what you can to reduce your
1:57:40footprint. Do what you can to help the
1:57:43environment. Do what you can to cut down
1:57:46your electrical
1:57:48use."
1:57:49>> I think you already do that, don't you,
1:57:50Mr. Crook? When you meet with these
1:57:52these applicants, you already point
1:57:54those things out to them, don't you?
1:57:56>> We point out what's been adopted in the
1:57:58land development plan and the in the
1:58:00zoning regulations.
1:58:01>> But that's not enough. And I don't want
1:58:03to waste your time. And then I'm not
1:58:05here to beat you up either. What I'm
1:58:08just saying is listen to us. We have we
1:58:12don't have all these terrible plans that
1:58:15involve communism.
1:58:17We want to do the right things. and we
1:58:20elected you to do the right things.
1:58:24That's all we're saying. Thank you.
1:58:29>> Okay. Is there anyone else in the
1:58:31audience who wishes to speak either in
1:58:32favor of or opposition to this request?
1:58:36>> Yes,
1:58:38>> and I'm not here about the sports this
1:58:40time, y'all.
1:58:42My name's Ma Shook and I actually live
1:58:45at 414 Riverview Road and I'm not kin to
1:58:48him, but I work with them for a lot of
1:58:49years. Congratulations, Steve. Anyway,
1:58:53I'm here. I have three a little over
1:58:55three acres that the whole back of my
1:58:58property is going to be on that. Right
1:58:59now, there's nothing on it, but I've
1:59:01always held on to it because as we're
1:59:04aging out, we thought about downsizing
1:59:06and and living there. So, it's going to
1:59:08affect me more than likely. Um
1:59:12I want what's the difference between RA1
1:59:14and 2 and RA3 and all that.
1:59:18>> Um the RA1 and RA2. Can we go back to
1:59:21the zoning map please?
1:59:24Both of them stand for rural
1:59:25agricultural district. The RA1 or let me
1:59:28start with RA2. RA2 is the least
1:59:30restrictive residential classification
1:59:32that we have. It will allow for single
1:59:34wide manufactured homes, double wides,
1:59:36modulars, stickuilt homes. You can do
1:59:38duplexes on 40,000 square ft. The RA1 is
1:59:41very similar. Stands for the same thing,
1:59:43RA1. And it basically allows everything
1:59:47except for the single wide. And a double
1:59:49wide has to have a masonry foundation.
1:59:52>> Okay. That's was my question.
1:59:54>> Okay.
1:59:54>> I know a a lady from our church fought
1:59:57before Edgar even thought about being
1:59:59here.
1:59:59>> Yes, ma'am.
2:00:00>> And they had all this changed. And I
2:00:02thought maybe it would be under
2:00:05Edgar and all that's on the other side
2:00:07of the road. Yes, ma'am. But this would
2:00:09be the first thing on that side of the
2:00:10road. Am I not right?
2:00:12>> Uh it would be the first non-residential
2:00:14use on that side of the pro on that side
2:00:16of Bel.
2:00:16>> I had the understanding that that
2:00:18wouldn't have us because at the time the
2:00:20county had offered us a good bit of
2:00:23money for that. So I would have sort of
2:00:24been in favor of it. But now with us,
2:00:28like I said, either my son or I one
2:00:30thought about of moving there, and I
2:00:33didn't know if that was under protected
2:00:36or anything, but I guess not.
2:00:38>> Well, the the the land development plan
2:00:40classifies that whole region as an
2:00:43economic development corridor, even on
2:00:44the north side of Belmont Road.
2:00:46>> Did you say it was in the Carolina
2:00:48corridor?
2:00:49>> No, no, no. The the
2:00:50>> I thought it's on up.
2:00:51>> Yeah, it's it's further to the east.
2:00:53It's further to the east.
2:00:55>> All right. That answers my question
2:00:56then. Hopefully the lights will not be
2:00:58bad if in the event that we do, but I
2:01:01just wanted to make sure.
2:01:04>> Well, that that was a concern of the
2:01:05planning board and they they wanted to
2:01:07address that.
2:01:08>> All right. Miss Shook, is your property
2:01:1063 or
2:01:12>> 33? Okay.
2:01:14>> Miss Shook is 33 according to our
2:01:16records.
2:01:17>> All right. Thank you.
2:01:19>> Thank y'all.
2:01:20>> Thank you.
2:01:23So I don't see anyone else. Um
2:01:27>> maybe
2:01:31>> Okay.
2:01:33>> Thank you. We um heard a bit about a
2:01:36couple of different topics. Duke Energy
2:01:38Data Centers. I want to make sure that
2:01:40we um remember what the charges say and
2:01:43it's actually pretty simple. it is this
2:01:45site that is shown on your screen and
2:01:48whether it um whether the resulting
2:01:51request is reasonable in light of the
2:01:53factors and the considerations that we
2:01:55talked about earlier. I won't go through
2:01:57all of those. Um I'll just take a minute
2:01:59to briefly address some um of the
2:02:02questions and comments. So whether we
2:02:04can choose a specific type of lighting
2:02:06right now, um I like to say that
2:02:09Arizona's permission to try as you know
2:02:12this will go through TRC process and
2:02:15we'll have that legally binding
2:02:17commitment that lighting will not uh be
2:02:19polluted and shined or shown into um
2:02:23adjacent properties as well as Belmont
2:02:25Road. Um there is one condition that I
2:02:28did not mention um but there is a
2:02:31condition to preserve um tree save where
2:02:35feasible on the site. Again that's
2:02:36another legally binding
2:02:39condition.
2:02:41We heard that we're asking for changes
2:02:43to the development regulations and
2:02:46ordinances. We're asking for a
2:02:48reasonzoning change, but there are no
2:02:50variances or relief sought from the
2:02:53regulations of the zoning ordinance.
2:02:56Currently, it will be built according to
2:02:58the regulations that the county has in
2:03:01place to protect public safety and
2:03:03welfare in this area. We're not asking
2:03:05for any relief from that.
2:03:11Um, as far as the roofs and the building
2:03:14standards, we're going to comply with
2:03:16North Carolina building codes, energy
2:03:17codes, local codes, North Carolina DEQ,
2:03:21storm water. Um, anything that's
2:03:23applicable to the site will be in
2:03:24compliance with our engineers will
2:03:27handle the design of that. Then the
2:03:28county has to approve it, including the
2:03:31zoning uh staff.
2:03:33>> And then just one more piece there. the
2:03:35concept plans were concept plans just
2:03:37that there is no dedication or
2:03:38commitment to a black roof and I don't
2:03:40know that that's what you contemplate
2:03:42but um we've heard the concerns and the
2:03:44feedback we take them serious we don't
2:03:47take them lightly and Jonathan um we
2:03:49heard corporations yes this technically
2:03:51is an LLC but these are local born and
2:03:54raised Davidson County developers who
2:03:56take pride and have integrity in the
2:03:58area and will no doubt um build this
2:04:01development according to those values
2:04:04Again, we are are happy to answer any
2:04:06further questions that you have, but we
2:04:08are requesting a a vote of approval. And
2:04:11again,
2:04:13would love to answer any other
2:04:15questions, but I think we've adequately
2:04:16addressed at least what uh we've heard
2:04:18from the community this evening.
2:04:20>> I got a question for Lee and maybe back
2:04:23at y'all. I don't know. We don't require
2:04:25anybody to asphalt or concrete their
2:04:28parking lot, do we?
2:04:29>> We do not. This this would be just a
2:04:32simple all-weather surface of gravel
2:04:33would be adequate for this unless
2:04:35there's some type of building code
2:04:37requirement for ADA accessibility where
2:04:40that would have to be paved or concreted
2:04:43>> for the gentleman talking about you know
2:04:45the whole parking lot or do y'all plan
2:04:47to pave it or anything or that's not in
2:04:49the existing plans concrete or pavement.
2:04:53I know it's nicer if you do, but it's
2:04:54not
2:04:55>> um we'll have hard services on entry and
2:05:00uh but where the uh larger parking spot
2:05:02spaces be for access um as long as
2:05:05budget allows, we plan to do that. Okay.
2:05:08>> And subject to the build upon area
2:05:10restrictions and limitations and the
2:05:11environmental um aspects of the
2:05:13ordinance that Mr. Crook uh briefly
2:05:16discussed earlier
2:05:18>> the NC DOT driveway permit which is a
2:05:21submitted condition that
2:05:22>> they're required to do it on D. I get
2:05:24that the first 50 foot would be uh paid.
2:05:27I didn't think there was anything. I
2:05:29know in some of the cities they that's
2:05:30why when you go to Walmart, you see all
2:05:32these or some of the shopping centers,
2:05:35all these parking spots that nobody uses
2:05:37is because the cities mandate that they
2:05:40have so many parking places per square
2:05:42foot, which I think they need to shrink
2:05:44that so we don't have so much parking.
2:05:46But you go to some of these shopping
2:05:49centers and half of them's uh parking
2:05:51spots are empty, you know. So, okay.
2:05:54That's neither here nor there, but there
2:05:56was a recent No, there was a I have some
2:05:58happy news to report to you possibly.
2:05:59There was a recent change to 160D, the
2:06:02land use laws to eliminate parking
2:06:04requirements for commercial uh
2:06:06development. So,
2:06:08>> state state level
2:06:09>> statewide. Awesome.
2:06:10>> Isn't that effective 1 to 27 though?
2:06:12>> I think that's correct.
2:06:13>> January 1 of 27, we will no longer be
2:06:16able to regulate parking requirements at
2:06:18the local level.
2:06:18>> Oh, wow. What's that uh what's that
2:06:20law's uh number?
2:06:22>> I can get you the session law. Um, I'll
2:06:24I'll write it down or follow up with
2:06:25you. I don't want to tell you wrong.
2:06:27>> Give it to We'll be doing a text change.
2:06:29>> He can forward it to us.
2:06:30>> Lots of changes coming.
2:06:31>> Yes.
2:06:32>> Okay.
2:06:33>> It's [clears throat] all the questions I
2:06:35have
2:06:35>> if if we're finished. Um, anything else
2:06:39you want to add at the end here?
2:06:42>> Happy to [clears throat] answer any
2:06:43questions you you all may have.
2:06:44>> Okay, I think we're good. I declare the
2:06:47public hearing closed. Mr. Crook, what's
2:06:50the staff recommendation?
2:06:52>> Thank you. As Miss Matthews alluded to,
2:06:54the planning board did approve this
2:06:55unanimously on at their August 18th
2:06:57meeting 5 to zero. Um, like to briefly
2:07:00go over the conditions that have been
2:07:02submitted. Obtain all required NC DOT
2:07:05driveway access permits. Pave for
2:07:06concrete the first 50 ft of the driveway
2:07:08entrance. Cover all drive issable areas
2:07:12with an all-weather hard surface
2:07:13material. Uh, maintain all setbacks
2:07:16required by Davidson County zoning
2:07:17ordinance. retain as many existing trees
2:07:20as is reasonably possible to provide
2:07:22natural screening, install and maintain
2:07:25all landscaping and screening required
2:07:26by the Davis County zoning ordinance.
2:07:28And you've also heard Miss Matthews
2:07:30alluded to the uh concerns being
2:07:32addressed by the planning board subject
2:07:34to applicable NC DOT and North Carolina
2:07:36state building code standards.
2:07:38regulations, fixtures located along or
2:07:40oriented towards an adjacent property
2:07:42line or Belmont Road shall include house
2:07:46side shields or equivalent shielding on
2:07:48the side facing the adjoining property
2:07:50or road. So those are the conditions
2:07:53that are offered as part of the
2:07:54application. Um the applicant wishes to
2:07:57reszone lot 26 to construct several
2:07:59compartmentalized storage buildings on
2:08:01the property. The subject track is
2:08:03completely surrounded by RA1 or RA2 rule
2:08:05agricultural zoning. Properties to the
2:08:07west are vacant and wooded. One of the
2:08:10properties to the north is vacant and
2:08:11the other has a dwelling located on
2:08:13site. The property to the south has a
2:08:16dwelling on it as well. The property to
2:08:18the east is vacant and wooded and
2:08:20belongs to and is a remnant of the
2:08:22Davidson County's I85 corporate center.
2:08:25That's the property that Mr. Cochran
2:08:27alluded to that was part of Davidson
2:08:30County but still zone residential. Um
2:08:33while this portion of Belmont Road is
2:08:35still vacant, Wooder residential, other
2:08:37uses are in very close proximity to this
2:08:39site, 700 ft to the southwest is the
2:08:42county's box site and the eastern edge
2:08:45of the county's I 85 corporate center
2:08:48industrial park. Um LI limited
2:08:50industrial zoning is to the east of this
2:08:53property as well, 1500 ft east on
2:08:55Belmont Road. And then again at the
2:08:57intersection of Lynwood Southmont Road
2:09:00um our industrially zone properties.
2:09:02Davidson County has extended public
2:09:04sewer to the area to accommodate the
2:09:06corporate center indicating change or
2:09:09changing conditions. Uh the Belmont Road
2:09:11interchange with I 85 has been
2:09:14substantially reworked resulting in much
2:09:17more traffic volume on said road.
2:09:19Davidson County's land development plan
2:09:21designates this area as an economic
2:09:22development corridor and therefore
2:09:24promotes non-residential development uh
2:09:27on site. Continued economic growth is
2:09:29anticipated in this area. Policies 1.2,
2:09:331.3, 1.5, 1.8, 1.16, 5.6, and 7.3
2:09:38of said land development plan uh support
2:09:41the applicant's request. The Davis
2:09:43County Zoning Ordinance Article 7
2:09:45administration section 7.10 10
2:09:48amendments offer support to the request
2:09:50of district expansion due to change or
2:09:52change conditions generally in the
2:09:55county and specifically in the area. As
2:09:57they were alluded to earlier, all of the
2:10:00new houses, nobody wants a basement
2:10:02anymore. The garages are, you know,
2:10:05garages and they're used for storage. We
2:10:07see these things, these types of uses
2:10:09going up all over the places and they're
2:10:11normally in close proximity to
2:10:13residential district. Um because the
2:10:16property will not perk, this is
2:10:17potentially the highest and best use of
2:10:20the property and staff would recommend
2:10:22approval uh of the application and asked
2:10:24you to adopt a resolution and statement
2:10:27of consistency.
2:10:29>> Do I have a motion and a second to
2:10:30either approve or deny the resing
2:10:33request? So move, madam chair, I make a
2:10:35motion that we approve the request and
2:10:37adopt this adopt the statement of
2:10:39consistency.
2:10:40>> Thank you, sir. Do we have a second?
2:10:43>> Second. Who's that?
2:10:44>> No, you can have a second. Go
2:10:45>> ahead. You [laughter] have I just I was
2:10:48waiting for you.
2:10:49>> Commissioner Male. Um,
2:10:52>> do I have a vote? All
2:10:55>> in favor? All in favor say I.
2:10:57>> I.
2:10:59>> Okay.
2:11:00>> Thank you, sir. All right. Item number
2:11:05D, resoning request in the Midway
2:11:07Township. Mr. Crook will introduce the
2:11:10application.
2:11:12>> All right. Uh before we get into this,
2:11:15Miss Matthews may have something to say.
2:11:17She approached me right during the
2:11:19meeting and and may have a request for
2:11:21the board.
2:11:23Again, Ladra Matthews on behalf of the
2:11:26applicant group 21, very respectful of
2:11:28your time and everyone's in the audience
2:11:30who presumably are here for this agenda
2:11:33item since they are still here. Um, so
2:11:36with that, I am regrettably making a
2:11:38request before you. As Mr. Crook said, I
2:11:40let him know as soon as we found out.
2:11:42The property owner intended to be uh a
2:11:45part of the presentation this evening.
2:11:48He was traveling or is traveling from
2:11:51out of town. We thought he was going to
2:11:52be here on time and he is not. So I'm
2:11:54asking or we are requesting a
2:11:56continuence until your October meeting
2:11:59to allow him to be here.
2:12:02>> I've said no.
2:12:03>> Separately, but relatedly, um we've been
2:12:06given specific instructions presumably
2:12:09because of the contentious nature of the
2:12:12case. Um Chairman Elliott or
2:12:16Commissioner Elliot, excuse me. Um, you
2:12:18alluded to some conditions that were
2:12:20offered for Belmont Avenue or
2:12:22contemplated during the hearing. There
2:12:24were also several contemplated during
2:12:26the planning board hearing. I think
2:12:28again rubbing my crystal ball and um
2:12:30speculating
2:12:32uh the planning board did not wish to um
2:12:36further develop or contemplate those um
2:12:40profered conditions at that meeting
2:12:41because I think they had in mind what
2:12:43their vote would be. Um the applicant is
2:12:47prepared to offer some of those
2:12:48conditions today, but we have been given
2:12:50specific instructions from the property
2:12:52owner um to not concede to any of those
2:12:55without his consent or present. So
2:12:57again, because of those two reasons,
2:12:58we're requesting a continuence until
2:13:00your October meeting.
2:13:02>> I don't have an issue with himself.
2:13:04>> I don't
2:13:11I'd say we can
2:13:12>> you had an opportunity to be here. just
2:13:14like all these people have.
2:13:16>> If he if he couldn't make it tough,
2:13:20>> he had an opportunity to be here just
2:13:21like all these people did.
2:13:26[applause]
2:13:28>> May I say one thing? He was local 18
2:13:30hours.
2:13:33Public hearing is not open.
2:13:38>> They knew this was here today.
2:13:43>> I think we need to go on with the
2:13:45hearing.
2:13:45>> Madam, we we continue them all the time
2:13:48though, Steve. This ain't nothing out of
2:13:49order.
2:13:52>> I just think it's obvious to me. I mean,
2:13:55we've all gotten the motion that their
2:13:56own town council passed. Overwhelmingly,
2:13:58they don't want this. These people have
2:14:00been sitting here all night. Obviously,
2:14:02this other guy's had a chance to be
2:14:04here. They've been sitting here all
2:14:05night. I said we go ahead with it. Wait
2:14:06a minute. This is not [applause]
2:14:13>> This is not in the town council here.
2:14:15This is not in the town. This piece of
2:14:17property.
2:14:17>> I'm talking the Midway Town Council
2:14:19passed a resolution not wanting this
2:14:21thing reszone.
2:14:27>> Postpone it. When when did y'all agree?
2:14:29>> When did y'all want to continue to the
2:14:31next meeting?
2:14:32>> Just until October.
2:14:35>> We continue.
2:14:42>> So, we can't continue it tonight though.
2:14:43Just get it done.
2:14:44>> Are they saying the property owner wants
2:14:46to be here
2:14:48>> for like the concessions or discussion?
2:14:51>> Discussion. Yeah.
2:14:54>> I mean, the area it can't handle the
2:14:57apartments. I know Eller I played
2:14:58paintball off the paint road.
2:15:00>> Madam Madam Chair, I I make a motion we
2:15:02vote to deny the the continuence.
2:15:05>> I second it.
2:15:06>> I have a motion in a second. All in
2:15:08favor say I.
2:15:10>> I.
2:15:12>> Thank you. [applause]
2:15:14>> Opposition
2:15:16>> I
2:15:16>> I
2:15:19>> Okay.
2:15:20>> Okay.
2:15:20>> Okay.
2:15:21>> Did you vote I or no, Chris? I didn't
2:15:23hear you down there. uh to go a way just
2:15:26to hear them.
2:15:29>> Okay.
2:15:29>> Chair Waterford, I know that we
2:15:31typically go into the staff um report,
2:15:34but having not been granted the
2:15:36continuence, we are left with
2:15:38withdrawing the application with the
2:15:40intent to refile with those additional
2:15:42conditions after receiving the property
2:15:44owner's blessing.
2:15:50>> Thank you. I appreciate it and again
2:15:52apologize. We are respectful of
2:15:54everyone's time. Thank you.
2:15:57>> Motion to go into
2:15:58>> Motion to go in close session.
2:16:00>> Okay.
2:16:01>> Second.
2:16:03>> All in favor?
2:16:04>> I just Madam Chair, you
2:16:18All
2:16:34right.
2:16:37Heat.
2:17:11Heat. Heat.
2:18:48Heat. Heat.
2:21:19Heat. Heat.
2:21:23Heat. Heat.
2:22:34Heat. Heat.
2:37:12Heat. Heat.
2:39:40back into close open session.
2:39:42>> Motion to come back in session.
2:39:44>> Okay. Second.
2:39:45>> Second.
2:39:46>> All in favor?
2:39:47>> I.
2:39:48>> Mr. Jones.
2:39:49>> Yes. The board um met in close session
2:39:52to discuss a um an outstanding legal
2:39:55issue and staff were given instructions
2:39:57on um how the board would like uh staff
2:39:59to proceed on that. That's it. Okay.
2:40:02Thank you. Motion
2:40:04second. All
2:40:05>> in favor say I. I.
